AN ACT TO AUTHORIZE THE HOLDER OF A MANUFACTURER'S PERMIT, CLASS 1, DISTILLER'S PERMIT WHO DISTILLS ALCOHOLIC BEVERAGES AT A DISTILLERY LOCATED IN THIS STATE TO MAKE SALES OF ALCOHOLIC BEVERAGES DISTILLED AT THE DISTILLERY TO CONSUMERS AT THE LOCATION OF THE DISTILLERY OR ITS IMMEDIATE VICINITY; TO AMEND SECTION 67-1-45, MISSISSIPPI CODE OF 1972, IN CONFORMITY THERETO; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The holder of a manufacturer's permit, Class 1, distiller's permit who distills alcoholic beverages at a distillery located in this state is authorized to make sales of alcoholic beverages distilled at the distillery to consumers at the location of the distillery or its immediate vicinity.

     SECTION 2.  Section 67-1-45, Mississippi Code of 1972, is amended as follows:

     67-1-45.  Except as otherwise provided in Section 1 of this act, no manufacturer, rectifier or distiller of intoxicating liquor shall sell or attempt to sell any such intoxicating liquor, except malt liquor, within the State of Mississippi, except to the commission, or to the holder of a research permit as provided in Section 67-1-41.  A producer of native wine may sell native wines to the commission or to consumers at the location of the native winery or its immediate vicinity.

     Any violation of this section by any manufacturer, rectifier or distiller shall be punished by a fine of not less than Five Hundred Dollars ($500.00), and not more than Two Thousand Dollars ($2,000.00), to which may be added imprisonment in the county jail not to exceed six (6) months.

     SECTION 3.  Section 1 of this act shall be codified as a new section in Chapter 1, Title 67, Mississippi Code of 1972.

     SECTION 4.  This act shall take effect and be in force from and after July 1, 2012.
