AN ACT TO AMEND SECTION 49-7-167, MISSISSIPPI CODE OF 1972, TO PLACE CERTAIN CONDITIONS ON NONPROFIT ORGANIZATIONS RECEIVING DUCK STAMP FUNDS FROM THE COMMISSION ON WILDLIFE, FISHERIES AND PARKS FOR MIGRATORY WATERFOWL PROJECTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 49-7-167, Mississippi Code of 1972, is amended as follows:

     49-7-167.  (1)  All revenue shall be used for projects approved by the commission for the purpose of protecting and propagating migratory waterfowl and for the development, restoration, maintenance or preservation of wetlands.  Provided, however, that none of such funds shall be expended for administrative salaries.

     (2)  The commission may enter into contracts with nonprofit organizations for the use of part of such funds outside the United States, if the commission finds that such contracts are necessary for carrying out the purposes of Sections 49-7-161 through 49-7-173.

     (3)  Each contract entered into shall require that the nonprofit organization match the requested funds at no less than a one-to-one ration.  The nonprofit organization shall be held accountable for all funds spent on the project.  The nonprofit organization shall provide the commission with a progress report on the expenditure and use of the funds.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
