AN ACT TO AMEND SECTION 23-15-1037, MISSISSIPPI CODE OF 1972, TO REVISE THE BOUNDARIES OF THE CONGRESSIONAL DISTRICTS TO CONFORM TO THE 2000 CENSUS DATA; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 23-15-1037, Mississippi Code of 1972, is amended as follows:

     23-15-1037.  (1)  The State of Mississippi is hereby divided into five (5) congressional districts as follows:

      FIRST DISTRICT.  The First Congressional District shall be composed of the following counties and portions of counties: Alcorn, Benton, Calhoun, Chickasaw, Choctaw, Clay, DeSoto, Grenada, Itawamba, Lafayette, Lee, Lowndes, Marshall, Monroe, Panola, Pontotoc, Prentiss, Tate, Tippah, Tishomingo, Union, Webster, Winston, Yalobusha; in Webster County, the precincts of Bellefontaine, Big Black, Bluff Springs, Cadaretta, Clarkson, Cumberland, Eupora 1, Eupora 2, Eupora 3, Fame, Fay, Grady, Mantee, Mathiston, North Walthall, South Walthall, Tomnolen; in Winston County, the precinct of Gum Branch.

     THIRD DISTRICT.  The Third Congressional District shall be composed of the following counties and portions of counties: Adams, Amite, Covington, Franklin, Hinds, Jasper, Jefferson Davis, Jones, Kemper, Lauderdale, Lawrence, Leake, Lincoln, Madison, Marion, Neshoba, Newton, Noxubee, Oktibbeha, Pike, Rankin, Scott, Simpson, Smith, Walthall, Webster, Wilkinson, Winston; in Hinds County, the precincts of 8, 9, 14, 17, 32, 33, 34, 35, 36, 37, 44, 45, 46, 78, 79; in Jasper County the precincts of Bay Springs Beat 3, Bay Springs Beat 4, Garlandsville, Holders Church, Louin, Montrose, in Jones County the precincts of Bruce, Centerville, Hebron; in Leake County the precincts of Ebenezer, Edinburg, Freeny, Good Hope, Lena, Madden, Renfroe, Salem, Sunrise, Walnut Grove; in Madison County the precincts of Bear Creek, Flora, Highland Colony Baptist Church, Lorman-Cavalier, Madison 1, Madison 2, Madison 3, Madisonville, Main Harbor, Ratliff Ferry, Ridgeland 1, Ridgeland 3, Ridgeland 4, Ridgeland First Methodist Church, Ridgeland Tennis Center, Smith School, Trace Harbor, Victory Baptist Church, Whispering Lake; in Marion County the precincts of Broom, Carley, Cedar Grove, Darbun, Foxworth, Goss, Kokomo, Morgantown, Pittman, Stovall and White Bluff; in Webster County the precinct of Maben; in Winston County the precincts of American Legion, Bethany, Betheden-Loakfoma, Bond, Calvary, County Agent, Crystal Ridge, Dean Park, E.M.E.P.A., Elementary School, Ellison Ridge, Fairground, Ford School, Hinze, Liberty, Lobutcha, Louisville Electric, Louisville High School, Lovorn Tractor, Mars Hill, Nanih Waiya, Nanih Waiya-Handle, New Hope, Noxapater, Old National Guard Armory, Sinai, Vowell, Zion Ridge.

      FOURTH DISTRICT.  The Fourth Congressional District shall be composed of the following counties and portions of counties: Clarke, Forrest, George, Greene, Hancock, Harrison, Jackson, Jasper, Jones, Lamar, Marion, Pearl River, Perry, Stone, Wayne; in Jasper County the precincts of Antioch, Claiborne, Cooks Mill, Fellowship, Heidelberg, Midway, Mossville, Palestine, Philadelphia, Ras, Rose Hill, Stringer, Vossburg; in Jones County the precincts of Anthonys Florist, Antioch (28067310), Blackwell, Calhoun, Cameron Center, Cooks Avenue Community Center, County Barn, Currie, Ellisville Court House, Erata, Gitano, Glade School, Johnson, Lamar School, Landrum Community Center, Laurel Courthouse, Maple Street YWCA, Mason School, Matthews, Moselle, Myrick, National Guard Armory, Nora Davis School, Oak Park School, Old Health Department, Ovett, Pendorf, Pinegrove, Pleasant Ridge, Powers Community Center, Rainey, Roosevelt, Rustin, Sandersville Civic Center, Sandhill, Shady Grove, Sharon, Shelton, Soso, South Jones Stainton, Tuckers, Twenty-Sixth Street Fire Station, Union, West Jones; in Marion County the precincts of Balls Mill, City Hall Beat 3, Courthouse Beat 4, East Columbia, Hub, Jefferson Middle School, Morris, National Guard Beat 1, Pinebur, Popetown Beat 2, Sandy Hook, South Columbia, Union (28091103).

     (2)  The boundaries of the congressional districts described in subsection (1) of this section shall be the boundaries of the counties and precincts listed in subsection (1) as such boundaries existed according to PL-94171 data that was provided to the Legislature and public following the 2000 census.

     SECTION 2.  The Attorney General of the State of Mississippi shall submit this act, immediately upon approval by the Governor, or upon approval by the Legislature subsequent to a veto, to the Attorney General of the United States or to the United States District Court for the District of Columbia in accordance with the provisions of the Voting Rights Act of 1965, as amended and extended.

     SECTION 3.  This act shall take effect and be in force from and after the date it is effectuated under Section 5 of the Voting Rights Act of 1965, as amended and extended.
