AN ACT TO AUTHORIZE A CORRECTIONAL FACILITY TO PURCHASE PRESCRIPTION MEDICATION IN AMOUNTS THAT WILL ALLOW SUCH CORRECTIONAL FACILITY TO DISPENSE PRESCRIPTION MEDICATION FROM A SINGLE CONTAINER TO INMATES DIAGNOSED WITH A HEALTH CONDITION WHICH REQUIRES THE SAME MEDICATION; TO AMEND SECTION 47-5-79, MISSISSIPPI CODE OF 1972, TO CONFORM TO THE PRECEDING SECTION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  A correctional facility may purchase prescription medication in amounts that will allow such facility to dispense prescription medication from a single container, in accordance with state health regulations, to inmates who have been diagnosed with a health condition which requires the same type of prescription medication.

     SECTION 2.  Section 47-5-79, Mississippi Code of 1972, is amended as follows:

     47-5-79.  All contracts for the purchase of materials, supplies, equipment and sustenance for the offenders of the correctional system shall be made under the provisions of the State Purchasing Law, same being Sections 31-7-1 through 31-7-55, and may authorize a correctional facility to purchase prescription medication in amounts that will allow the correctional facility to dispense prescription medication in the manner described in Section 1, House Bill No.    , 2011 Regular Session

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2011.
