AN ACT TO REQUIRE THE DEPARTMENT OF CORRECTIONS TO ALLOW A DESIGNATED INDIVIDUAL TO ACCESS THE MEDICAL RECORDS OF AN OFFENDER IF THE OFFENDER HAS PROVIDED ADVANCED WRITTEN CONSENT FOR SUCH ACCESS AND IF THE DESIGNATED INDIVIDUAL PAYS CERTAIN REQUIRED PHOTOCOPYING FEES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Department of Corrections shall allow any offender to provide advanced expressed written consent that designates an individual, of the offender's choosing, to have the right of access to the medical records of the offender if the designated individual pays the required photocopying fees for the medical records as prescribed in Section 11-1-52.  After the fees referred to in this section are paid, the department shall release the medical records to the individual designated by the offender. 

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
