AN ACT TO PROVIDE THAT THE LAUDERDALE COUNTY, MISSISSIPPI, BOARD OF SUPERVISORS MAY, WITH RESPECT TO ANY COMPANY CONSTRUCTING AND LOCATING A MAJOR CAPITAL PROJECT, AS DEFINED BY THE MISSISSIPPI MAJOR ECONOMIC IMPACT ACT, APPORTION, DIVIDE AND ALLOCATE THE SUM ALLOWED AS A FEE-IN-LIEU PURSUANT TO SECTION 27-31-104, MISSISSIPPI CODE OF 1972, IN SUCH PROPORTION TO THE SCHOOL DISTRICT THAT IS AGREED UPON IN NEGOTIATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  With respect to any fee-in-lieu agreement the Board of Supervisors of Lauderdale County, Mississippi, enters pursuant to Section 27-31-104, Mississippi Code of 1972, in connection with a company locating in the county that qualifies as a major economic impact project pursuant to Section 57-75-5, Mississippi Code of 1972, the board of supervisors may negotiate with the school district in which the project is located and apportion to the school district an amount of the fee-in-lieu that is agreed upon in negotiation different from the amount provided for in Section 27-31-104.

     SECTION 2.  The authority to provide for the allocation and apportionment of fee-in-lieu revenues as authorized by this act shall be an alternative to the allocation methodology as set forth in Section 27-31-104.

     SECTION 3.  This act shall take effect and be in force from and after its passage.
