AN ACT TO PROHIBIT A PRIVATE OR PUBLIC EMPLOYER FROM USING AN ARREST RECORD AS A BASIS TO DENY AN APPLICANT AN EMPLOYMENT POSITION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any person, firm or corporation who alone, or in conjunction with others, willfully denies an applicant an employment position based upon the applicant's criminal arrest record, or any employer who dissuades any person from applying for an employment position because of the person's criminal arrest record, shall be guilty of a misdemeanor and on conviction thereof, shall be punished by a fine not to exceed One Thousand Dollars ($1,000.00) or by imprisonment for not more than six (6) months, or both such fine and imprisonment.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
