AN ACT TO PROHIBIT CERTAIN INFORMATION FROM BEING ELECTRONICALLY PRINTED ON DEBIT AND CREDIT CARD RECEIPTS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  For the purposes of this section, "person" means any individual, firm, partnership, association, corporation, limited liability company, organization or other entity, but does not include the state or any political subdivision of the state, or any agency thereof.

     (2)  Beginning January 1, 2011, no person who accepts credit cards or debit cards for the transaction of business may print on a receipt provided to the cardholder:  (a) more than the last five (5) digits of the credit card or debit card account number, or (b) the expiration date of the credit card or debit card.

     (3)  The provisions of subsection (2) of this section apply only to receipts that are electronically printed and do not apply to transactions in which the sole means of recording the cardholder's credit card or debit card account number is by handwriting or by an imprint or copy of the credit card or debit card.

     (4)  Any person who willfully violates the provisions of subsection (2) of this section shall be subject to a fine of not more than One Hundred Dollars ($100.00) for a first offense and not more than Five Hundred Dollars ($500.00) for a second offense, and shall be subject to a fine of not more than One Thousand Dollars ($1,000.00) for each subsequent offense.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
