Senate Bill 2137

AN ACT TO REQUIRE ANY INSURER DELIVERING OR ISSUING A POLICY OF ACCIDENT AND SICKNESS INSURANCE, AS A CONDITION OF DOING BUSINESS IN THE STATE OF MISSISSIPPI, TO ENTER INTO AN AGREEMENT WITH THE COMMISSIONER OF INSURANCE TO OFFER STATE-QUALIFIED HEALTH INSURANCE UNDER THE FEDERAL HEALTH CARE TAX CREDIT PROGRAM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any insurer delivering or issuing a policy of accident and sickness insurance, as defined by Section 83-9-1, shall, as a condition of doing business in the State of Mississippi, enter into an agreement with the Commissioner of Insurance to offer state-qualified health insurance under the federal Health Care Tax Credit Program, 26 USC Section 35.  The Commissioner of Insurance is authorized to promulgate rules and regulations to carry out the provisions of this act. 

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
