AN ACT TO AUTHORIZE THE BOARD OF TRUSTEES OF THE CLAIBORNE COUNTY ECONOMIC DEVELOPMENT DISTRICT TO EXPEND CERTAIN FUNDS FOR THE ACQUISITION, DEVELOPMENT AND IMPROVEMENT OF REAL ESTATE WITHIN CLAIBORNE COUNTY; TO PROVIDE THAT SUCH REAL ESTATE IS TO BE USED FOR AN INDUSTRIAL PARK OR SITE; TO AUTHORIZE THE TRUSTEES TO SELL, LEASE, TRADE, EXCHANGE OR OTHERWISE DISPOSE OF SITES LOCATED WITHIN INDUSTRIAL PARKS IN THE COUNTY; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Board of Supervisors of Claiborne County, Mississippi, may, in its discretion, authorize the trustees of the Claiborne County Economic Development District to expend any monies in the county treasury available for economic and industrial development for the purposes prescribed in this section.
(2) The monies authorized to be expended in this section may be expended for the acquisition, development and improvement of real estate within Claiborne County, Mississippi, to be used for an industrial park or parks or sites, and for such purposes, the Claiborne County Economic Development District shall have the following authority:
(a) To own, hold, maintain, control and develop the real estate;
(b) To engage in works of internal improvement of the real estate including, but not limited to, construction or contracting for the construction of streets, roads, railroads, spur tracks, site improvements, water, sewerage, drainage, pollution control and other related facilities necessary or required for industrial or commercial use and development of industrial park or site complexes; and
(c) To acquire, purchase, install, lease, construct, own, hold, equip, control, maintain, use, operate and repair other structures and facilities necessary and convenient for the planning, development, use, operation and maintenance of such industrial park or parks or sites including, but not limited to, utility installations, elevators, compressors, warehouses, buildings, air, rail and other transportation terminals and pollution control facilities.
(3) The trustees of the Claiborne County Economic Development District are further authorized and empowered to sell, lease, trade, exchange or otherwise dispose of sites situated within industrial parks or sites to individuals, firms or corporations, public or private, for industrial, commercial, warehouse and other uses including, but not limited to, retail or other commercial activities, upon such terms and conditions, and for such considerations, with such safeguards as will best promote and protect the public interest, convenience and necessity, and to execute deeds, leases, contracts, easements and other legal instruments necessary or convenient for such purposes.
SECTION 2. This act shall take effect and be in force from and after its passage.
