AN ACT TO AMEND SECTION 45-11-301, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT POSTING AND EMBLEM IDENTIFYING A BUILDING AS HAVING TRUSS CONSTRUCTION IS DISCRETIONARY; TO REVISE THE DEFINITION OF TRUSS; TO REMOVE MUNICIPAL AND COUNTY FIRE CODE OR COORDINATOR ENFORCEMENT PROVISIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 45-11-301, Mississippi Code of 1972, is amended as follows:
45-11-301. (1) The owner of a building located in the State of Mississippi with a floor or ceiling constructed with truss construction may attach to the building an emblem that identifies the building as having truss construction. If attached, the emblem shall:
(a) Be permanently affixed to the left of the main entrance door at a height between four (4) feet and six (6) feet above the ground;
(b) Be of a bright and reflective color or made of a reflective material;
(c) Be in the shape of an isosceles triangle measuring six (6) inches horizontally and three (3) inches vertically;
(d) Have conspicuously printed on it the following letters, as appropriate, based on the type of truss construction used in the building being identified by the emblem:
(i) "F" to signify a floor with truss construction;
(ii) "R" to signify a roof with truss construction; or
(iii) "F/R" to signify both a floor and roof with truss construction.
(2) This section does not apply to a building with truss construction that is a detached one- or two-family residential structure.
(3) For purposes of this section, the term "truss" shall mean an engineered pre-built component, designed to carry its own weight and added superimposed design loads, that most often functions as a structural support member.

(4) The State Fire Marshal may promulgate rules and regulations necessary for the implementation of this section.
SECTION 2. This act shall take effect and be in force from and after July 1, 2010.
