AN ACT TO CREATE A NEW SECTION TO BE CODIFIED AS SECTION 73-54-43, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT WHENEVER ANY LAW, REGULATION OR POLICY OF THE STATE OR A POLITICAL SUBDIVISION OF THE STATE AUTHORIZES OR ALLOWS A LICENSED SOCIAL WORKER TO PERFORM SERVICES THAT ARE WITHIN THE LAWFUL SCOPE OF THE PRACTICE OF MARRIAGE AND FAMILY THERAPY, THOSE SERVICES MAY BE PERFORMED BY A LICENSED MARRIAGE AND FAMILY THERAPIST TO THE EXTENT THAT THOSE SERVICES ARE WITHIN THE LAWFUL SCOPE OF THE PRACTICE OF MARRIAGE AND FAMILY THERAPY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 73-54-43, Mississippi Code of 1972:

     73-54-43.  Whenever any law, regulation or policy of the State of Mississippi or any agency, department, institution or political subdivision of the state authorizes or allows a licensed social worker to perform services that are within the lawful scope of the practice of marriage and family therapy as defined in Section 73-54-5, those services may be performed by a marriage and family therapist licensed under this chapter to the extent that those services are within the lawful scope of the practice of marriage and family therapy.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
