AN ACT TO PROHIBIT MOTOR VEHICLE DEALERS FROM CHARGING FEES FOR SERVICES RENDERED TO, FOR OR ON BEHALF OF A PURCHASER IN PREPARING, HANDLING OR PROCESSING DOCUMENTS RELATING TO THE SALE OR LEASE OF A MOTOR VEHICLE; TO SET FORTH A PENALTY FOR THE ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  It shall be unlawful for a licensed dealer, as that term is defined in Section 63-21-5, to charge or collect any fee for services rendered to, for or on behalf of a purchaser in preparing, handling or processing documents relating to the sale or lease of a motor vehicle, unless that fee is specifically authorized or required by law.

     SECTION 2.  Any person violating the provisions of this section is guilty of a misdemeanor and, upon conviction, shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00), or by a term of imprisonment not exceeding six (6) months, or by both the fine and imprisonment.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2010.
