AMENDMENT NO 1 PROPOSED TO
House Bill No. 1609

Amend by striking all after the enacting clause and inserting in lieu thereof the following:
SECTION 1. (1) There is created a study committee to determine the feasibility of the Harrison County Board of Supervisors to contract with a private entity for the management, operations and maintenance of a private county jail. The study committee shall consist of the following five (5) members:
(a) The Chairperson of the House of Representatives of the Corrections Committee;
(b) The Chairperson of the Senate Corrections Committee;
(c) One (1) member from the House of Representatives, appointed by the Speaker of the House of Representatives;
(d) One (1) member from the Senate, appointed by the Lieutenant Governor; and
(e) One (1) member, appointed by the Governor.
(2) At its first meeting the study committee shall elect a chairperson and vice chairperson from its membership and shall adopt rules for transacting its business and keeping its records.
(3) The member of the task force who is not a legislator, state official or state employee shall be compensated at the per diem rate authorized by Section 25-3-69 and shall be reimbursed in accordance with Section 25-3-41 for mileage and actual expenses incurred in the performance of his or her duties. Legislative members of the study committee shall be paid from the contingent expense funds of their respective houses in the same manner as provided for committee meetings when the Legislature is not in session. However, no per diem or expense for attending meetings of the study committee will be paid to the legislative members of the study committee while the Legislature is in session. No study committee member may incur per diem, travel or other expenses unless previously authorized by vote, at a meeting of the study committee, which shall be recorded in the official minutes of the meeting. Nonlegislative members shall be paid from any funds made available to the study committee for that purpose.
(4) To effectuate the purposes of this section, any department, division, board, bureau, commission or agency of the state or any political subdivision thereof shall, at the request of the chairperson of the study committee, provide to the study committee such facilities, assistance and data as will enable the study committee to properly carry out its task.
(5) By January 8, 2008, the study committee shall make a report of its work and recommendations.
SECTION 2. This act shall take effect and be in force from and after its passage.
Further, amend by striking the title in its entirety and inserting in lieu thereof the following:
AN ACT TO CREATE A STUDY COMMITTEE TO DETERMINE THE FEASIBILITY OF THE HARRISON COUNTY BOARD OF SUPERVISORS TO CONTRACT WITH A PRIVATE ENTITY FOR THE MANAGEMENT, OPERATIONS AND MAINTENANCE OF A PRIVATE JAIL; AND FOR RELATED PURPOSES.
