AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, UPON CONSULTATION WITH THE CHAIRMEN OF THE PUBLIC PROPERTY COMMITTEES OF THE SENATE AND HOUSE OF REPRESENTATIVES, TO SELL AND CONVEY OR LEASE THE PROPERTY LOCATED AT 239 NORTH LAMAR STREET IN THE CITY OF JACKSON, HINDS COUNTY, MISSISSIPPI, KNOWN AS THE "ROBERT E. LEE BUILDING"; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) After consulting with the Chairmen of the Public Property Committees of the Senate and House of Representatives, the Department of Finance and Administration may sell and convey or lease, whichever is determined to be in the best interest of the State of Mississippi, the state-owned property known as the "Robert E. Lee Building" and located at 239 North Lamar Street in the City of Jackson, Hinds County, Mississippi, and being more particularly described as follows:
The East One Hundred and Seventy Feet (170 ft) of
the hereinafter described property which is the
East 170 ft of Parcel "A" in Hinds County Deed Book
1822 at page 136. Beginning at the Southwest
intersection of Griffith Street and Lamar Street as
same are now (January 1966) laid out and improved and
run thence West along the South line of Griffith Street
for a distance of 180 feet, more or less, to the
Northwest corner of that certain parcel of land conveyed
to the Gammill Company by Deed recorded in Book 237,
Page 443, run thence Southerly and along the West line
of said parcel for 144 feet, more or less, to the
Southwest corner of said parcel; turn thence to the
left and run West 21.5 feet, more or less, to the
Northeast corner of that certain parcel of land
conveyed to Gammill Investment Company by Warranty
Deed recorded in Book 246, Page 149, run thence West
or Westerly and along the South line of Lots 23, 22,
21, 20 and 19 to a point which is 18 feet West of the Southeast corner of Lot 18 of Richard Griffith's
Subdivision, according to a map or plat thereof on
file and of record in the office of the Chancery
Clerk of Hinds County at Jackson, Mississippi, in
Plat Book A, Page 297, thence run Southerly to the
Northwest corner of Lot 8 of the McQuaid Fitzgerald Subdivision as per plat Book 2, page 50; thence
Easterly and along the North line of Lots 8 through
20, inclusively, of said Subdivision to the Southeast
corner of that certain parcel conveyed to the Gammill Investment Company by instrument recorded in Book 246,
Page 149; thence run Easterly and along the North line
of the property which formerly belonged to the Sisters
of Mercy to a point in the West line of Lamar Street
which point is the Southeast corner of that certain
parcel of land conveyed to Sutton by instrument
recorded in Book 167, Page 319, thence Northerly
along the West line of Lamar Street 241.2 feet, more
or less, to the point of beginning, being all property
of the Grantor herein bounded on the East by Lamar
Street, on the North by Griffith Street, on the South
by the property formerly owned by the Sisters of Mercy, McQuaid Street and McQuaid Fitzgerald Subdivision, and
on the West by Farish Street, as said streets are
presently laid out and improved. The grantor herein
does convey to the Grantee all of the property that
they own bordered by the above mentioned description,
whether properly described or not.
The above conveyance shall be accompanied by a long
term lease (up to 30 years) for use of a certain portion
of the Parking Garage which is known as the Robert E.
Lee Parking Garage. Said Parking Garage is located immediately West of the above described property and
access to the garage is also granted from State owned property immediately South of the above described
property. Access to the said Parking Garage is also
available directly from Griffith Street. The details
of the parking arrangement and access thereto will be formalized in the conveyance document.
(2) Money derived from the sale of state-owned property authorized in this act shall be deposited into the State General Fund.
(3) The State of Mississippi shall retain the right to repurchase the real property sold pursuant to this act in the event such property is not used, or ceases to be used for the intended purpose, or is otherwise abandoned by the purchaser.
(4) The State of Mississippi shall retain all mineral rights to the real property sold pursuant to this act.
(5) The provisions of this act shall stand repealed from and after September 1, 2008. However, any contract or lease entered into by the Department of Finance and Administration pursuant to this act before September 1, 2008, shall remain in effect until the expiration of the contract or lease.
SECTION 2. This act shall take effect and be in force from and after its passage.
