AN ACT TO AMEND CHAPTER 972, LOCAL AND PRIVATE LAWS OF 2004, TO DELETE THE REPEALER ON THE PROVISION OF LAW THAT AUTHORIZES THE GOVERNING AUTHORITIES OF THE CITY OF GREENWOOD TO EXPEND MONIES, PROVIDE IN-KIND SERVICES AND USE NONVIOLENT MUNICIPAL INMATES TO CLEAN AND MAINTAIN THE CEMETERY OF GOOD SHEPHERD AND THE MAGNOLIA CEMETERY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Chapter 972, Local and Private Laws of 2004, is amended as follows: 

     (1)  The governing authorities of the City of Greenwood, in their discretion, may set aside, appropriate and expend, out of any available funds of the municipality, a sum not to exceed Ten Thousand Dollars ($10,000.00) in any fiscal year and, in addition, may provide in-kind services, including the use of county employees, equipment and supplies, for the purpose of cleaning and maintaining the Cemetery of Good Shepherd and the Magnolia Cemetery.

     (2)  In addition to the authority granted under subsection (1) of this section, the governing authorities of the City of Greenwood, in their discretion, may use any person who has been convicted of a nonviolent offense and who is serving all or any part of his sentence in the municipal jail for the purpose of cleaning and maintaining the Cemetery of Good Shepherd and the Magnolia Cemetery.

     (3)  The City of Greenwood, its employees and agents shall not be liable for any damage caused to any headstone, grave site, fence or other appurtenance of the Cemetery of Good Shepherd or the Magnolia Cemetery.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
