House Bill 1475

AN ACT TO PROHIBIT POSSESSION OF CERTAIN ELECTRICAL WEAPONS BY ANYONE OTHER THAN LAW ENFORCEMENT OFFICERS; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  No person other than certified law enforcement officers shall possess a portable device or weapon from which an electric current, impulse, wave or beam may be directed, which current, impulse, wave or beam is designed to incapacitate temporarily, injure or kill.  The purpose of these portable devices and weapons is to momentarily stun, knock out, cause mental disorientation, or paralyze.  Whoever violates this section shall be guilty of a misdemeanor and, upon conviction, shall be punished by a fine of not less than Five Hundred Dollars ($500.00)

nor more than One Thousand Dollars ($1,000.00) or by imprisonment for not less than six (6) months nor more than one (1) year, or both.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2007.
