House Bill 1278

AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO ASSIGN TO THE DEPARTMENT OF EDUCATION CERTAIN STATE-OWNED REAL PROPERTY IN TISHOMINGO COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) The Department of Finance and Administration shall assign to the Department of Education certain state-owned real property located in Tishomingo County, Mississippi, in the Yellow Creek, Indian Creek, and Bear Creek areas of Pickwick Landing Lake, which lands comprise nine (9) separate tracts and are more particularly described as follows:

TRACT NO. XTPR-9

A tract of land lying in the SE1/4 sec. 30, sec. 31, and SW1/4 sec. 32, T. 1 S., R. 11 E., and in the W1/2 sec. 5, E1/2 sec. 6, E1/2 sec. 7, sec. 8, SW1/4 sec. 9, NW1/4 sec. 16, W1/2 sec. 17, E1/2 sec. 18, E1/2 sec. 19, and the W1/2 sec. 20, T. 2 S., R. 11 E., on the southwest shores of Pickwick Landing Lake at the Indian Creek Embayment, and more particularly described as follows:

Beginning at US-TVA Monument 93 (Coordinates: N. 1,919,876; E. 698,646) at the common corner of secs. 31 and 32, T. 1 S., R. 11 E. and secs. 5 and 6, T. 2 S., R. 11 E., and in the boundary of the United States of America's land at a corner to the land of the Wood Preserving Corporation; thence with the United States of America's boundary S. 89° 39' W., 1336 feet to US-TVA Monument 94 at the southwest corner of the SE1/4 SE1/4 sec. 31. thence S. 62° 44' E., approximately 896 feet, passing a metal marker at 868 feet, to a point in the 414-foot contour on the southwest shore of Pickwick Landing Lake; thence with the 414-foot contour as it meanders in a general southeasterly direction to a point immediately north of the mouth of the Short Creek Inlet; thence, leaving the 414-foot contour, N. 78° 08' W., approximately 20 feet to a point in the 423-foot contour; thence N. 78° 08' W., 1558 feet, passing a metal marker (Coordinates: N. 1,916,976; E. 700,181) at 9 feet, to a metal marker in the west line of sec. 5, T. 2 S., R. 11 E.; thence with the west line of sec. 5 S. 0° 29' E., approximately 262 feet, passing a metal marker in the 423-foot contour at 232 feet, to a point in the 414-foot contour on the north shore of the Short Creek Inlet; thence with the 414-foot contour as it meanders in a westerly direction to the west end of the inlet and thence down the south shore of the inlet in an easterly direction to a point in the east line of sec. 6; thence with the 414-foot contour as it meanders in a general southwesterly direction to a point in the south line of sec. 5; thence with the south line of sec. 5 S. 89° 37' W., approximately 20 feet to a metal marker (Coordinates: N. 1,914,597; E. 698,861) in the 423-foot contour; thence continuing with the south line of sec. 5 and subsequently with the south line of sec. 6 S. 89° 37' W., 533 feet to a metal marker in the center line of a road; thence with the center line of the road as it meanders in a southerly direction approximately 700 feet, passing a metal marker in the 423-foot contour at approximately 650 feet, to a point in the 414-foot contour on the northwest shore of an inlet of the Indian Creek Embayment; thence with the 414-foot contour as it meanders in a southwesterly direction to the southwest end of the inlet, thence down the southeast shore of the inlet in a northeasterly direction to its mouth, thence up the west shore of the Indian Creek Embayment in a general southerly direction to the south end of the embayment, and thence down the east shore of the said embayment in a general northerly direction to a point; There are hereby expressly EXCEPTED AND EXCLUDED from the above described land and from this conveyance 231. acres, more or less, being those portions of the said land which lie below elevation 423.

The above described land, after giving effect to the exclusion above noted, contains 813. acres, more or less.

The easement areas appurtenant to the above described fee tract comprise all that land lying between the 423-foot contour which forms the lakeward boundary of the above described fee tract and the waters of Pickwick Landing Lake, but shall not include any land identified as follows: (1) Land lying west and northwest of a line commencing at a point in the 423-foot contour N. 0° 03' E., 13 feet from the metal marker that is passed at 415 feet in that course identified in the above metes and bounds description by a bearing and distance of N. 0° 03' E., approximately 448 feet, and extending thence N. 0° 03' E., approximately 70 feet to a point in the center line of a drain and thence with the center line of the drain as it meanders downsteam to an intersection with the waters of Pickwick Landing Lake; (2) Land lying adjacent to the safety landing on the north side of the Whetstone Creek Inlet and which is bounded on the north by a line commencing at a point in the 423-foot contour at the east end of that course identified in the above metes and bounds description by a bearing and distance of N. 83° 35' W., 1570 feet, and extending thence S. 83° 35' E., approximately 20 feet to a point in the 414-foot contour and thence N. 75° E. to an intersection with the waters of Pickwick Landing Lake, and on the west by a line commencing at the metal marker that is passed at 138 feet in that course identified in the above metes and bounds description by a bearing and distance of S. 0° 46' E., approximately 158 feet, and extending thence S. 0° 46' E. to an intersection with the waters of Pickwick Landing Lake; (3) Land lying adjacent to the safety landing on the south side of the Whetstone Creek Inlet and which is bounded on the south and northwest by a line commencing at the metal marker

at the west end of that course identified in the above metes and bounds description by a bearing and distance of S. 72° 43' E., 1637 feet, and extending thence N. 72° 43' W., approximately 90 feet to a point in the center line of a drain and thence with the center line of the drain as it meanders downstream to an intersection with the waters of Pickwick Landing Lake, and on the southwest and south by a line commencing at a point in the 423-foot contour S. 62° 44' E., 8 feet from the metal marker that is passed at 868 feet in that course identified in the above metes and bounds description by a bearing and distance of S. 62° 44' E., approximately 896 feet, and extending thence S. 62° 44' E., approximately 20 feet to a point in the 414-foot contour and thence N. 70° E. to an intersection with the waters of Pickwick Landing Lake; (4) Land lying adjacent to the safety landing on the north side of the Short Creek Inlet and which is bounded on the north by a line commencing at a point in the 423-foot contour at the east end of that course identified in the above metes and bounds description by a bearing and distance of N. 78° 08' W., 1558 feet, and extending thence S. 78° 08' E., to an intersection with the waters of Pickwick Landing Lake, and on the west by a line commencing at the metal marker that is passed at 232 feet in that course identified in the above metes and bounds description by a bearing and distance of S. 0° 29' E., approximately 262 feet, and extending thence S. 0° 29' E. to an intersection with the waters of Pickwick Landing Lake; (5) Land lying adjacent to the safety landing on the southwest side of the Short Creek Inlet and which is bounded on the west by a line commencing at a metal marker at the north end of that course identified in the above metes and bounds description by a bearing and distance of S. 0° 29' E., 194 feet, and extending thence N. 0° 29' W. to an intersection with the waters of Pickwick Landing Lake, and on the south by a line commencing at a point in the 423-foot contour S. 84° 32' E., 6 feet from the metal marker that is passed at 201 feet in that course identified in the above metes and bounds description by a bearing and distance of S. 84° 32' E., approximately 227 feet, and extending thence S. 84° 32' E., to an intersection with the waters of Pickwick Landing Lake; (6) Land lying adjacent to the safety landing on the west side of the Indian Creek Embayment, immediately north of the Rock Creek Inlet and being bounded on the north by a line commencing at the metal marker at the east end of that course identified in the above metes and bounds description by a bearing and distance of S. 89° 37' W., 533 feet, and extending thence N. 89° 37' E., to an intersection with the waters of Pickwick Landing Lake, and on the west and south by a line commencing at the metal marker that is passed at approximately 650 feet in that course identified in the above metes and bounds description as with the center line of a road as it meanders in a southerly direction approximately 700 feet, and extending thence with the center line of the road in a southerly direction approximately 50 feet to a point in the 414-foot contour; thence leaving the road, due south approximately 75 feet to a point in the center line of Rock Creek, and thence with the center line of the creek as it meanders downstream to an intersection with the waters of Pickwick Landing Lake; (7) Land lying adjacent to the safety landing on the east side of and at the mouth of the Indian Creek Embayment and being bounded on the south by a line commencing at the metal marker at the west end of that course identified in the above metes and bounds description by a bearing and distance of S. 89° 01' E., 276 feet, and extending thence N. 89° 01' W. to an intersection with the waters of Pickwick Landing Lake, and on the southeast by a line commencing at a point in the 423-foot contour N. 48° 59' E., 12 feet from the metal marker that is passed at 1252 feet in the course identified in the above metes and bounds description by a bearing and distance of N. 48° 59' E., approximately 1284 feet, and extending thence N. 48° 59' E. to an intersection with the waters of Pickwick Landing Lake; and (8) Land lying south and east of a line commencing at the metal marker at the east end of that course identified in the above metes and bounds description by a bearing and distance of S. 78° 25' W., 118 feet, and extending thence with the boundary of the land embraced by the above mentioned metes and bounds description N. 78° 25' E., approximately 10 feet to a point in the center line of a branch, thence with the center line of the branch as it meanders downstream approximately 400 feet to a headout of the 414-foot contour at the southeast end of an inlet, thence with the 414-foot contour as it meanders down the northwest shore of the inlet to a point, thence leaving the 414-foot contour, N. 50° 30' W., approximately 20 feet to a metal marker in the 423-foot contour, thence N. 50° 30' W., 201 feet to a metal marker and thence N. 27° 41' E., passing a metal marker at 335 feet, a metal marker at 392 feet, and a metal marker (Coordinates: N. 1,908,765; E. 705,567) at 1370 feet, to an intersection with the waters of Pickwick Landing Lake.

Furthermore, to afford a means of ingress to and egress from the above described fee tract and appurtenant easement area, the grantor hereby conveys to the grantee, with any others who may be designated by the grantor, the right to construct, maintain, and use a road on, over, and across a right of way 50 feet wide, lying 25 feet on each side of a center line described as follows: Beginning at a point S. 2° 47' E., 25 feet from the metal marker at the north end of that course identified in the above metes and bounds description by a bearing and distance of N. 2° 47' W., 1771 feet; thence S. 88° 43' W., approximately 200 feet to a point in the center line of an existing road; thence with the center line of the existing road as it meanders in a southerly direction approximately 1820 feet to a point in a county road; together with the right to do the necessary work of construction and maintenance of said road and the necessary work in connection with the maintenance of any drainage ditches and other road appurtenances on land lying outside of but adjacent to the limits of the right of way.

TRACT NO. XTPR-10

A tract of land lying in sec. 24, T. 2 S., R. 11 E., on the west shore of and at the mouth of the Bear Creek Embayment of Pickwick Landing Lake, and more particularly described as follows:

Beginning at a metal marker in the center line of a county road, in the west line of sec. 24, and in the boundary between the lands of the United States of America and A.F. Whitehurst & V.E. Ware from which US-TVA Monument 51, (Coordinates: N. 1,900,516; E. 719,418) at a corner in the said boundary and at the northwest corner of the SW1/4 SW1/4 sec. 24 bears N. 1° 30' W. at a distance of 718 feet; thence with the center line of the road as it meanders in a general northeasterly direction approximately 975 feet, passing a metal marker in the 423-foot contour at approximately 925 feet, to a point in the 414-foot contour on the shore of the Bear Creek Embayment; thence with the 414-foot contour as it meanders in a general southerly direction to a point; thence leaving the 414-foot contour, N. 89° 36' W., approximately 80 feet to a metal marker in the 418-foot contour and in the boundary of the United States of America's land; thence with the United States of America's boundary N. 89° 36' W., 600 feet, passing a metal marker in the 423-foot contour at 49 feet, to US-TVA Monument 50 buried in the center line of an old road and in the west line of sec. 24; thence N. 1° 30' W., 96 feet to the point of beginning.

There are hereby expressly EXCEPTED AND EXCLUDED from the above described land and from this conveyance 2.4 acres, more or less, being that portion of the said land which lies below elevation 423.

The above described land, after giving effect to the exclusion above noted, contains 6.4 acres, more or less.

The easement area appurtenant to the above described fee tract comprises all that land lying between the lakeward boundary of the above described fee tract and the waters of Pickwick Landing Lake, but it shall not include any lands lying south of a line commencing at the metal marker at the southeast corner of the above described fee tract, and extending thence S. 89° 36' E., to an intersection with the waters of Pickwick Landing Lake; nor shall it include any land lying north of a line commencing at the metal marker in the center line of a road at the northeast corner of the above described fee tract, and extending thence with the center line of the road in the easterly direction approximately 50 feet to a point in the 414-foot contour and thence due east to an intersection with the waters of Pickwick Landing Lake.

TRACT NO. XTPR-11

A tract of land lying in the S1/2 sec. 35, T. 2 S., R. 11 E., and in sec. 2, T. 3 S., R. 11 E., on the southwest shores of the Bear Creek Embayment of Pickwick Landing Lake, approximately 2 miles south of the mouth of the said embayment, and more particularly described as follows:

Beginning at US-TVA Monument 37 (Coordinates: N. 1,887,140; E. 716,942) at the southwest corner of the NW1/4 NE1/4 sec. 2 and in the boundary of the United States of America's land at a corner of the lands of the Southern Timber Lands Company and the Wood Preserving Corporation; thence with the United States of America's boundary S. 89° 27' W., 664 feet to US-TVA Monument 38 at the southwest corner of the SE1/4 NE1/4 NW1/4 sec. 2; thence N. 0° 39' E., 1367 feet to US-TVA Monument 39 at the northwest corner of the NE1/4 NE1/4 NW1/4 sec. 2; thence N. 89° 15' E., 320 feet to US-TVA Monument 40 at the southwest corner of the SE1/4 SE1/4 SE1/4 SW1/4 sec. 35; thence N. 0° 58' E., 1343 feet to US-TVA Monument 30 at the northwest corner of the NE1/4 NE1/4 SE1/4 SW1/4 sec. 35; thence N. 43° 18' W., 457 feet to US-TVA Monument 31 at the southwest corner of the NW1/4 SE1/4 NE1/4 SW1/4 sec. 35; thence continuing with the United States of America's boundary for the first 583 feet N. 0° 11' W., approximately 613 feet, passing a metal marker in the 423-foot contour at 536 feet and a metal marker in the 418-foot contour at 583 feet, to a point in a headout of the 414-foot contour on the south shore of the Fish Trap Hollow Inlet of the lake; thence with the 414-foot contour as it meanders in a general easterly direction to the mouth of the Fish Trap Hollow Inlet and thence up the Bear Creek Embayment in a general southeasterly direction to a point on the south shore of an inlet and in the Mississippi-Alabama state boundary line; thence leaving the 414-foot contour and with the said state boundary line S. 5° 04' W., approximately 20 feet to a point in the 423-foot contour; thence S. 5° 04' W., 856 feet, passing a metal marker at 5 feet, to US-TVA Monument 34 in the boundary of the United States of America's land; thence with the United States of America's boundary, leaving the state boundary line, due west, 1320 feet to US-TVA Monument 35; thence N. 6° 09' E., 1796 feet to US-TVA Monument 36 in the south line of the NW1/4 NE1/4 sec. 2; thence S. 89° 26' W., 1030 feet to the point of beginning.

There are hereby expressly EXCEPTED AND EXCLUDED from the above described land and from this conveyance 14.2 acres, more or less, being that portion of said land which lies below elevation 423.

The above described land, after giving effect to the exclusion above noted, contains 123. acres, more or less.

The easement area appurtenant to the above described fee tract comprises all that land lying between the lakeward boundary of the above described fee tract and the waters of Pickwick Landing Lake, but shall not include any lands lying east and southeast of a line commencing at the point in the 423-foot contour at the north end of that course identified in the above metes and bounds description by a bearing and distance of S. 5° 04' W., 856 feet, and extending thence with the Mississippi-Alabama state boundary line N. 5° 04' E., approximately 150 feet to a point in the center line of a drain and thence with the center line of the drain as it meanders downstream to an intersection with the waters of Pickwick Landing Lake; nor shall it include any lands lying west of a line commencing at the metal marker of the most northwesterly corner of the above described fee tract, and extending thence N. 0° 11' W., to an intersection with the waters of Pickwick Landing Lake.

TRACT NO. XTPR-12

A tract of land lying in the S1/2 S1/2 sec. 10, the NW1/4 sec. 14, and the N1/2 NE1/4 sec. 15, T. 3 S., R. 11 E., on the shores of the Little Bear Creek Embayment of Pickwick Landing Lake, approximately 4-1/4 miles south of the mouth of the Bear Creek Embayment of the lake, and more particularly described as follows:

Beginning at US-TVA Monument 19 (Coordinates: N. 1,877,460; E. 711,659) at the southwest corner of the NW1/4 NW1/4 NW1/4 NE1/4 sec. 15 and in the boundary of the United States of America's land at a corner of the lands of the Wood Preserving Corporation and T.N. Thompson; thence with the United States of America's boundary N. 0° 05' W., 337 feet to US-TVA Monument 20 at the northwest corner of the NE1/4 sec. 15; thence S. 89° 39' W., 330 feet to US-TVA Monument 21 at the southwest corner of the SE1/4 SE1/4 SE1/4 SW1/4 sec. 10; thence with the west line of the E1/2 E1/2 SE1/4 SW1/4 sec. 10 N. 0° 34' W., 1282 feet, passing a metal marker in the 423-foot contour at 212 feet, a metal marker in the 423-foot contour at 971 feet, and a metal marker at 1256 feet, to a point in the center line of a branch, said point being S. 0° 34' E., 23 feet from US-TVA Monument 22 at the northwest corner of the NE1/4 NE1/4 SE1/4 SW1/4 sec. 10; thence leaving the United States of America's boundary and with the center line of the branch as it meanders downstream approximately 855 feet to a point where the 414-foot contour heads at the west end of an inlet of the Little Bear Creek Embayment; thence with the 414-foot contour as it meanders down the south shore of the inlet and subsequently the south shores of the Little Bear Creek Embayment in a general easterly direction to the mouth of the embayment and thence up the Bear Creek Embayment in a southerly direction to a point; thence, leaving the 414-foot contour, due west approximately 70 feet to a point in the boundary of the United States of America's land; thence with the United States of America's boundary due west, 933 feet, passing a metal marker at 22 feet, to a metal marker in the west line of sec. 14; thence N. 0° 26' W., 531 feet to US-TVA Monument 17 at the northwest corner of the SW1/4 SW1/4 NW1/4 NW1/4 sec. 14; thence N. 0° 46' E., 666 feet to US-TVA Monument 18 at the northwest corner of the SW1/4 NW1/4 NW1/4 NW1/4 sec. 14; thence S. 89° 39' W., 2643 feet to the point of beginning.

There are hereby expressly EXCEPTED AND EXCLUDED from the above described land and from this conveyance 24.2 acres, more or less, being that portion of said land which lies below elevation 423.

The above described land, after giving effect to the exclusion above noted, contains 46.0 acres, more or less.

The easement area appurtenant to the above described fee tract comprises all that land lying between the lakeward boundary of the above described fee tract and the waters of Pickwick Landing Lake, but it shall not include any lands lying west and north of a line commencing at a point in the 423-foot contour which is N. 0° 34' W., 8 feet from the metal marker that is passed at 1256 feet in that course identified in the above metes and bounds description by a bearing and distance of N. 0° 34' W., 1282 feet, and extending thence with the boundary of the land embraced by the above metes and bounds description N. 0° 34' W., 18 feet to a point in the center line of a branch, thence with the center line of the branch as it meanders downstream to an intersection with the waters of Pickwick Landing Lake; nor shall it include any lands lying south of a line commencing at a point in the 423-foot contour at the east end of that course identified in the above metes and bounds description by a bearing and distance of due west, 933 feet, and extending thence due east to an intersection with the waters of Pickwick Landing Lake.

(2) Upon assignment of the real property described in subsection (1), the Department of Education shall have the exclusive use and control of the property for purposes consistent with the purposes established in the original conveyance by the Tennessee Valley Authority, acting for the government of the United States, to the State of Mississippi by virtue of Contract TV-19487A, dated June 19, 1958, in accordance with House Bill 914, General Laws of 1956, which appropriated funds for a survey of the property deeded to be used in accordance with management and use plan of the property.

SECTION 2. This act shall take effect and be in force from and after its passage.
