AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION TO GRANT SPECIFIC EASEMENTS TO THE BOARD OF SUPERVISORS OF MADISON COUNTY, OVER AND ACROSS CERTAIN STATE-OWNED REAL PROPERTY LOCATED IN MADISON, COUNTY, MISSISSIPPI, FOR THE IMPROVEMENT OF INDUSTRIAL DRIVE AND GLUCKSTADT ROAD; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The Department of Finance and Administration may grant specific easements to the Board of Supervisors of Madison County, Mississippi, over and across certain state-owned real property located in Madison County, Mississippi, for the improvement of Industrial Drive and Gluckstadt Road.  Such real property shall be more particularly described as follows:

     TEMPORARY CONSTRUCTION EASEMENT

                        A parcel of land containing 0.38 acres (16,412.66 square feet), more or less, being situated in the SouthEast 1/4 of Section 21, Township 8 North, Range 2 East, Madison County, Mississippi, and being more particularly described by metes and bounds as follows:

          Commence at the point of intersection of the East right-of-way line of Industrial Drive North with the North right-of-way line of Gluckstadt Road as both are now laid out and in use (March 2005), per plat of Industrial Center right-of-way, (plat recorded in Slides C-172, and C-173 in the Office of the Madison County Chancery Clerk); thence run along said right-of-way of Industrial Drive North North 00 degrees 06 minutes 21 seconds East for a distance of 597.29 feet to the POINT OF BEGINNING for the parcel herein described; thence leave said right-of-way and run South 02 degrees 24 minutes 56 seconds East for a distance of 64.79 feet; thence South 00 degrees 18 minutes 18 seconds West for a distance of 150.01 feet; thence South 07 degrees 20 minutes 11 seconds East for a distance of 201.53 feet; thence South 02 degrees 05 minutes 43 seconds West for a distance of 150.13 feet; thence South 13 degrees 16 minutes 08 seconds East for a distance of 46.18 feet; thence South 43 degrees 25 minutes 47 seconds East for a distance of 72.39 feet to the North right-of-way line of Gluckstadt Road; thence run along said right-of-way North 89 degrees 46 minutes 31 seconds East for a distance of 59.13 feet; thence leave said right-of-way and run North 60 degrees 45 minutes 04 seconds East for a distance of 30.78 feet; thence South 88 degrees 16 minutes 54 seconds East for a distance of 100.04 feet; thence North for a distance of 10.00 feet; thence North 88 degrees 13 minutes 57 seconds West for a distance of 102.38 feet; thence South 60 degrees 45 minutes 04 seconds West for a distance of 22.07 feet; thence North 74 degrees 37 minutes 47 seconds West for a distance of 82.40 feet; thence North 12 degrees 39 minutes 33 seconds West for a distance of 147.28 feet; thence North 02 degrees 05 minutes 43 seconds East for a distance of 86.65 feet; thence North 69 degrees 51 minutes 42 seconds East for a distance of 49.19 feet; thence North 00 degrees 22 minutes 44 seconds West for a distance of 45.01 feet; thence North 76 degrees 15 minutes 30 seconds West for a distance of 60.55 feet; thence North 07 degrees 20 minutes 11 seconds West for a distance of 105.80 feet; thence North 00 degrees 18 minutes 18 seconds East for a distance of 149.58 feet; thence North 02 degrees 24 minutes 56 seconds West for a distance of 64.81 feet; thence North 00 degrees 06 minutes 21 seconds East for a distance of 135.10 feet; thence South 89 degrees 43 minutes 56 seconds West for a distance of 10.00 feet to the Eastern right-of-way line of Industrial Drive North; thence run along said right-of-way South 00 degrees 06 minutes 21 seconds West for a distance of 135.26 feet to the POINT OF BEGINNING.

     RIGHT-OF-WAY PARCEL 1

          A parcel of land containing 0.06 acres (2,678.19 square feet), more or less, being situated in the SouthEast 1/4 of Section 21, Township 8 North, Range 2 East, Madison County, Mississippi, and being more particularly described by metes and bounds as follows:

          Commence at the point of intersection of the East right-of-way line of Industrial Drive North with the North right-of-way line of Gluckstadt Road as both are now laid out and in use (March 2005), per plat of Industrial Center right-of-way, (plat recorded in Slides C-172, and C-173 in the Office of the Madison County Chancery Clerk); thence run along said right-of-way of Gluckstadt Road South 52 degrees 11 minutes 56 seconds East for a distance of 105.86 feet; thence North 89 degrees 46 minutes 31 seconds East for a distance of 59.13 feet to the POINT OF BEGINNING; thence leave said right-of-way and run North 60 degrees 45 minutes 04 seconds East for a distance of 30.78 feet; thence South 88 degrees 16 minutes 54 seconds East for a distance of 100.04 feet; thence North 89 degrees 46 minutes 31 seconds East for a distance of 100.00 feet; thence South for a distance of 11.54 feet to the North right-of-way of Gluckstadt Road; thence run along said right-of-way South 89 degrees 46 minutes 31 seconds West for a distance of 226.86 feet to the POINT OF BEGINNING.

     RIGHT-OF-WAY PARCEL 2

          A parcel of land containing 0.21 acres (9,089.02 square feet), more or less, being situated in the SouthEast 1/4 of Section 21, Township 8 North, Range 2 East, Madison County, Mississippi, and being more particularly described by metes and bounds as follows:

          Commence at the point of intersection of the East right-of-way line of Industrial Drive North with the North right-of-way line of Gluckstadt Road as both are now laid out and in use (March 2005), per plat of Industrial Center right-of-way, (plat recorded in Slides C-172, and C-173 in the Office of the Madison County Chancery Clerk), said point of intersection also being the POINT OF BEGINNING for the parcel herein described; thence run along said right-of-way of Industrial Drive North North 00 degrees 06 minutes 21 seconds East for a distance of 597.29 feet; thence leave said right-of-way and run South 02 degrees 24 minutes 56 seconds East for a distance of 64.79 feet; thence South 00 degrees 18 minutes 18 seconds West for a distance of 150.01 feet; thence South 07 degrees 20 minutes 11 seconds East for a distance of 201.53 feet; thence South 02 degrees 05 minutes 43 seconds West for a distance of 150.13 feet; thence South 13 degrees 16 minutes 08 seconds East for a distance of 46.18 feet; thence South 43 degrees 25 minutes 47 seconds East for a distance of 72.39 feet to the North right-of-way line of Gluckstadt Road; thence run along said right-of-way North 52 degrees 11 minutes 56 seconds West for a distance of 105.86 feet to the POINT OF BEGINNING.

     (2)  The easements authorized in this section may be made on such terms and conditions agreed upon by the Department of Finance and Administration and the Board of Supervisors of Madison County, Mississippi, to be in the best interests of both parties.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
