AMENDMENT NO 1 TO COMMITTEE AMENDMENT NO 1 PROPOSED TO

     AMEND by striking lines 920 through 930 and insert in lieu thereof the following:

     The State Department of Health, on or before July 1, 2006, shall transfer the certificate of need authorized under the authority of this paragraph (a)(iii) to 5900 Highway 39 North in Meridian (Lauderdale County), Mississippi, for the addition, construction or expansion of child/adolescent psychiatric residential treatment facility beds in Lauderdale County.  For purposes of this subparagraph, the provisions of Section 41-7-193(1) requiring substantial compliance with the projection of need as reported in the current State Health Plan and the provisions of Section 41-7-197 requiring a formal certificate of need hearing process are waived.  The total number of beds that may be authorized under the authority of this subparagraph shall not exceed twenty (20) beds.  There shall be no prohibition or restrictions on participation in the Medicaid program (Section 43-13-101 et seq.) for the hospital receiving the certificate of need authorized under this subparagraph (a)(iii) or for the beds covered pursuant to the authority of that certificate of need.

     FURTHER, AMEND the title on line 29 after the semicolon by inserting the following:

TO PROVIDE THAT THE STATE DEPARTMENT OF HEALTH SHALL TRANSFER A CERTIFICATE OF NEED FOR PSYCHIATRIC RESIDENTIAL TREATMENT FACILITY BEDS FROM WARREN COUNTY TO RANKIN COUNTY AND SHALL TRANSFER A CERTIFICATE OF NEED FOR CHILD/ADOLESCENT PSYCHIATRIC BEDS FROM WARREN COUNTY TO LAUDERDALE COUNTY;
