AMENDMENT NO 1 PROPOSED TO

Cmte Sub for House Bill No. 1202

     AMEND by striking Section 3 in its entirety and inserting in lieu thereof the following:

     "SECTION 3.  (1)  It shall be unlawful for any person or entity, public or private, to intentionally or knowingly:

          (a)  Implant or attempt to implant into a uterus or the functional equivalent of a uterus the product of nuclear transfer, further described as the transplantation of a nucleus from a human somatic cell into an oocyte from which then nucleus or all chromosomes have been remove or rendered inert, to produce a living organism with a human or predominantly human genetic constitution; or

          (b)  Ship the product of nuclear transfer in interstate or foreign commerce for the purpose of implanting into a uterus or the functional equivalent of a uterus.

     (2)  (a)  Any person or entity that violates any provision of this section shall be guilty of a misdemeanor, and upon conviction thereof, shall be fined not more than Ten Thousand Dollars ($10,000.00) or imprisoned in the county jail for not more than one (1) year, or both.

          (b)  Any person or entity that violates any provision of this section shall be subject to, in the case of a violation that involves the derivation of a pecuniary gain, a civil penalty of not less than One Million Dollars ($1,000,000.00) and not more than an amount equal to the amount of the gross gain multiplied by two (2), if that amount is greater then One Million Dollars ($1,000,000.00)."
