Senate Bill 2376

AN ACT TO CREATE SECTION 93-15-113, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR CONTEMPORANEOUS TERMINATION OF GRANDPARENTS' RIGHTS IN THE SAME PROCEEDING AS A TERMINATION OF PARENTAL RIGHTS; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. The following shall be codified as Section 93-15-113, Mississippi Code of 1972:

93-15-113. In any petition to terminate parental rights, the termination of grandparents' visitation rights existing under Title 93, Chapter 16, Mississippi Code of 1972, may be sought contemporaneously in the complaint, and the court may terminate those rights on the same proof as required in this chapter, provided service of process is had upon the grandparents whose rights are sought to be terminated.

SECTION 2. This act shall take effect and be in force from and after July 1, 2006.
