House Bill 419

AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF ANY MUNICIPALITY OR THE BOARD OF SUPERVISORS OF ANY COUNTY TO DEDUCT OR PERMIT TO BE DEDUCTED FROM THE SALARY OF A MUNICIPAL OR COUNTY EMPLOYEE DUES OR FEES PAYABLE TO AN ORGANIZATION OR ASSOCIATION AT THE WRITTEN REQUEST OF THE EMPLOYEE INVOLVED; TO BRING FORWARD SECTIONS 37-9-49 AND 25-3-67, MISSISSIPPI CODE OF 1972, FOR PURPOSES OF AMENDMENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The governing authorities of any municipality or the board of supervisors of any county may deduct or permit to be deducted from the salary of a municipal or county employee, with a written request by the employee involved, any dues or fees payable to an organization or association because of membership of the employee in the organization or association. 

     SECTION 2.  Section 37-9-49, Mississippi Code of 1972, is brought forward as follows:

     37-9-49.  It shall be unlawful for the superintendent of schoolsto deduct or permit to be deducted from the salary of any superintendent, principal or licensed employee any dues, fines or penalties payable or alleged to be payable because of the membership of such superintendent, principal or licensed employee in any organization or association.  However, dues or premiums in health associations or corporations and tax sheltered annuity deductions authorized by the United States Internal Revenue Code may be deducted upon written authorization from the superintendent, principal or licensed employee involved.  Any superintendent of schools who shall make any such deduction or permit any such deduction to be made, except those herein provided, shall be guilty of a misdemeanor and upon conviction shall be punished by a fine of not more than Twenty-five Dollars ($25.00) for each such deduction.

     SECTION 3.  Section 25-3-67, Mississippi Code of 1972, is brought forward as follows:

     25-3-67.  The governing authorities of any municipality may, within their discretion, deduct from the salary of any individual municipal employee an amount to be deposited with the municipal credit union, contributions for the United Way, life, health-and-accident insurance and United States Savings Bonds, if a request for such deductions is made in writing by the employee.  SECTION 4.  This act shall take effect and be in force from and after July 1, 2006.
