AN ACT TO PROHIBIT LICENSED HOSPITALS AND STATE INSTITUTIONS OF HIGHER LEARNING FROM SPONSORING OR CONDUCTING ANY NEW CLINICAL TRIAL UNLESS THE RESULTS OF THE CLINICAL TRIAL WILL BE MADE AVAILABLE TO THE PUBLIC AND REGISTERED WITH A WEBSITE DEVELOPED BY THE NATIONAL INSTITUTES OF HEALTH; TO PROHIBIT THE INSTITUTIONAL REVIEW BOARDS OF LICENSED HOSPITALS AND STATE INSTITUTIONS OF HIGHER LEARNING FROM APPROVING ANY NEW CLINICAL TRIAL UNLESS THEY HAVE DETERMINED THAT THE RESULTS OF THE CLINICAL TRIAL WILL BE MADE PUBLIC AS REQUIRED BY THIS ACT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) For the purposes of this section, "clinical trial" means a research study in human volunteers to answer specific health questions.
(2) Licensed hospitals and state institutions of higher learning located in the state shall not sponsor or conduct any new clinical trial on or after July 1, 2006, unless (a) the results of the clinical trial will be made available to physicians, other health care professionals and the public, and (b) the clinical trial is registered with clinicaltrials.gov, or any successor website developed by the United States National Institutes of Health for the registration of clinical trials, and the results of the clinical trial are submitted to that website.
(3) The institutional review boards of licensed hospitals and state institutions of higher learning located in the state shall not approve any new clinical trial to be conducted on or after July 1, 2006, unless it has determined that the results of the clinical trial will be made public as required by this section.
SECTION 2. This act shall take effect and be in force from and after July 1, 2006.
