AN ACT TO PROVIDE THAT FROM JULY 1, 2005, THROUGH JUNE 30, 2007, THE SALARY OF ANY APPOINTED STATE OFFICIAL OR EMPLOYEE ESTABLISHED IN SECTION 25-3-33, MISSISSIPPI CODE OF 1972, AS IT EXISTED ON JUNE 30, 2003, SHALL BE REDUCED TO THE LEVEL SPECIFIED BY THE STATE PERSONNEL BOARD IN THE VARIABLE COMPENSATION PLAN FOR FISCAL YEAR 2004, REGARDLESS OF THE CURRENT TITLE OF, OR POSITION HELD BY, THOSE STATE OFFICIALS OR EMPLOYEES; TO AUTHORIZE THE STATE PERSONNEL BOARD TO TAKE SUCH ACTIONS AS NECESSARY TO REDUCE THE SALARIES OF ANY EMPLOYEE AFFECTED BY THE REDUCTION IN THE SALARY OF SUCH EXECUTIVE HEAD OF THE STATE AGENCY; TO DIRECT THE STATE FISCAL OFFICER TO TRANSFER CERTAIN SPECIAL FUNDS INTO THE BUDGET CONTINGENCY FUND DURING FISCAL YEAR 2006; TO DIRECT THE STATE FISCAL OFFICER TO TRANSFER A CERTAIN SUM FROM FUND NO. 4201 TO FUND NO. 4230; TO AUTHORIZE THE STATE TREASURER TO MAKE TRANSFERS TO PAY THE PRINCIPAL AND INTEREST ON BONDS AS THEY COME DUE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  From and after July 1, 2005, through June 30, 2007, the salary of any appointed state official or employee established in Section 25-3-33, Mississippi Code of 1972, as it existed on June 30, 2003, shall be reduced to the level specified by the State Personnel Board in the Variable Compensation Plan for Fiscal Year 2004, regardless of the current title of, or position held by, those state officials or employees.  The State Personnel Board shall take such actions as necessary to reduce the salary of any employee affected by the reduction in the salary of the executive head of the state agency in which he is employed in order to comply with Section 25-3-39(2), Mississippi Code of 1972.

     SECTION 2.  The State Fiscal Officer shall transfer to the Budget Contingency Fund created in Section 27-103-301, out of the following enumerated special funds, the amount listed below for each fund during the period beginning July 1, 2005, and ending June 30, 2006:

     SECTION 3.  The State Fiscal Officer shall transfer Sixteen Million Four Hundred Twenty-one Thousand Nine Hundred Twenty-three Dollars ($16,421,923.00) from Fund No. 4201 to Fund No. 4230.

     SECTION 4.  Through June 30, 2006, the State Treasurer may transfer from any funds in the State Treasury an amount to pay the principal of and the interest on state general obligation bonds as they become due.

     SECTION 5.  This act shall take effect and be in force from and after July 1, 2005.
