AN ACT MAKING AN ADDITIONAL APPROPRIATION OF GENERAL AND SPECIAL FUNDS TO DEFRAY THE EXPENSES OF THE FOLLOWING AGENCIES AND OBLIGATIONS FOR FISCAL YEAR 2005:  THE DEPARTMENT OF HUMAN SERVICES, THE MISSISSIPPI DEPARTMENT OF CORRECTIONS, STATE OF MISSISSIPPI BOND AND INTEREST PAYMENTS, THE DEPARTMENT OF MENTAL HEALTH, THE OFFICE OF THE ATTORNEY GENERAL, THE DEPARTMENT OF FINANCE AND ADMINISTRATION, THE JUDICIAL PERFORMANCE COMMISSION, THE OIL AND GAS BOARD, THE STATE DEPARTMENT OF HEALTH, THE PUBLIC SERVICE COMMISSION, THE BOARD OF DENTAL EXAMINERS, THE BOARD OF PUBLIC CONTRACTORS, AND THE DEPARTMENT OF REHABILITATION SERVICES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund not otherwise appropriated, to defray the expenses of the Mississippi Department of Human Services, for the purpose of funding the general operating expenses of the department, for the fiscal year ending June 30, 2005$   5,000,000.00.

SECTION 2.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund not otherwise appropriated, to defray the expenses of the Mississippi Department of Corrections, for the purpose of funding increased utility costs and other expenses incurred by the department, for the fiscal year ending June 30, 2005

SECTION 3.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund, not otherwise appropriated, for the purpose of making payments on bonds and interest on the full faith and credit bonds of the State of Mississippi falling due in the fiscal year ending

June 30, 2005................................ $   16,000,000.00.

Of the funds appropriated in this section, the amount of Six Million Dollars ($6,000,000.00) shall be used to reimburse the State General Fund for funds previously expended by the State Treasurer but not authorized by appropriation of the Legislature.

SECTION 4.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury which is comprised of special source funds for the purpose of making payments on bonds and interest on the full faith and credit bonds of the State of Mississippi falling due in the fiscal year ending June 30, 2005...... $    6,000,000.00.

The funds appropriated in this section shall authorize the funds previously expended by the State Treasurer.

SECTION 5.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund not otherwise appropriated, to defray the expenses of the Mississippi Department of Mental Health, for the purpose of funding Medicaid match at the community mental health centers, for the fiscal year ending June 30, 2005$    2,000,000.00.

SECTION 6.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund not otherwise appropriated, to defray the expenses of the Office of the Attorney General, for the purpose of defraying the costs of certain outside legal assistance, expert witness fees and court fees incurred by the Office of the Attorney General, for the fiscal year ending June 30, 2005    $   1,210,384.00.

The funds appropriated in this section shall be allocated as follows:

SECTION 7.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Department of Finance and Administration, for the purpose of defraying the expenses incurred in the operation of the various offices of the department, for the period beginning upon passage of this act and through

June 30, 2005................................. $   1,200,000.00.

     This additional appropriation of special fund spending authority is provided for the purpose of paying utility expenses of state-owned buildings.

SECTION 8.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Judicial Performance Commission, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005   $     55,000.00.

SECTION 9.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Oil and Gas Board, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005     $     108,000.00.

SECTION 10.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the Health Care Expendable Fund created in Section 43-13-407, Mississippi Code of 1972, to defray the expenses of the Mississippi State Department of Health for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005

SECTION 11.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Public Service Commission, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005    $     100,000.00.

SECTION 12.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Board of Dental Examiners, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005    $       7,000.00.

SECTION 13.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Board of Public Contractors, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005    $     100,000.00.

SECTION 14.  In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Department of Rehabilitation Services, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005   $   7,100,000.00.

     SECTION 15.  The money herein appropriated shall be paid by the State Treasurer out of any money in the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 16.  This act shall take effect and be in force from and after its passage.
