AN ACT MAKING AN ADDITIONAL APPROPRIATION OF GENERAL AND SPECIAL FUNDS TO DEFRAY THE EXPENSES OF THE FOLLOWING AGENCIES AND OBLIGATIONS FOR FISCAL YEAR 2005: THE DEPARTMENT OF HUMAN SERVICES, THE MISSISSIPPI DEPARTMENT OF CORRECTIONS, STATE OF MISSISSIPPI BOND AND INTEREST PAYMENTS, THE OFFICE OF THE ATTORNEY GENERAL, THE DEPARTMENT OF FINANCE AND ADMINISTRATION, THE JUDICIAL PERFORMANCE COMMISSION, THE OIL AND GAS BOARD, THE STATE DEPARTMENT OF HEALTH, THE PUBLIC SERVICE COMMISSION, THE BOARD OF DENTAL EXAMINERS, THE BOARD OF PUBLIC CONTRACTORS, AND THE DEPARTMENT OF REHABILITATION SERVICES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund not otherwise appropriated, to defray the expenses of the Mississippi Department of Human Services, for the purpose of funding the general operating expenses of the department, for the fiscal year ending June 30, 2005. $ 5,000,000.00.

SECTION 2. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund not otherwise appropriated, to defray the expenses of the Mississippi Department of Corrections, for the purpose of funding increased utility costs incurred by the department, for the fiscal year ending June 30, 2005.. $ 11,142,622.00.

SECTION 3. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund, not otherwise appropriated, for the purpose of making payments on bonds and interest on the full faith and credit bonds of the State of Mississippi falling due in the fiscal year ending

June 30, 2005. $ 8,000,000.00.

SECTION 4. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the General Fund not otherwise appropriated, to defray the expenses of the Office of the Attorney General, for the purpose of defraying the costs of certain outside legal assistance, expert witness fees and court fees incurred by the Office of the Attorney General, for the fiscal year ending June 30, 2005. $ 1,210,384.00.

The funds appropriated in this section shall be allocated as follows:

SECTION 5. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Department of Finance and Administration, for the purpose of defraying the expenses incurred in the operation of the various offices of the department, for the period beginning upon passage of this act and through

June 30, 2005. $ 1,446,300.00.

With the funds appropriated under the provisions of this section, the following positions are authorized:

Permanent: Full Time . . . . . 6

This additional appropriation of special fund spending authority is provided for the purpose of paying utility expenses of state-owned buildings, expenses associated with construction, maintenance, repair and related expenses of state-owned buildings, and providing authority to provide security services to state agencies within the Capitol Complex.

SECTION 6. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Judicial Performance Commission, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005$ 55,000.00.

SECTION 7. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Oil and Gas Board, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005$ 108,000.00.

SECTION 8. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the State Department of Health, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005$ 160,000.00.

SECTION 9. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Public Service Commission, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005$ 100,000.00.

SECTION 10. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Board of Dental Examiners, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005$ 7,000.00.

SECTION 11. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Board of Public Contractors, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005$ 100,000.00.

SECTION 12. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Department of Rehabilitation Services, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005. $ 1,500,000.00.

SECTION 13. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the Mississippi Department of Rehabilitation Services, which is comprised of any special source funds collected by or otherwise available to the department, for the purpose of defraying the expenses of the department, for the fiscal year ending June 30, 2005.................$ 5,600,000.00.

SECTION 14. The money herein appropriated shall be paid by the State Treasurer out of any money in the proper fund or funds as set forth in this act, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

SECTION 15. This act shall take effect and be in force from and after its passage.
