AMENDMENT NO 3 TO AMENDMENT NO 1 PROPOSED TO

Amend by inserting the following paragraph after line 760 and renumbering:
(b) Effective March 1, 2005, in order to qualify for prescription drug coverage under the Medicaid program, recipients shall be subject to the following gross income restrictions: Eligible recipients shall only be individuals whose income does not exceed one hundred percent (100%) of the official federal poverty level as determined by the Office of Management and Budget and revised annually, except for pregnant women and children less than one (1) year of age whose income may not exceed one hundred seventy-five percent (175%) of the federal poverty level and children over one (1) year of age and less than five (5) years of age whose income may not exceed one hundred thirty-three percent (133%) of the federal poverty level. The eligibility of pregnant women and children up to age nineteen (19) is determined solely on the income of the family or individual, and the eligibility of all other individuals for prescription drug coverage is determined on the income and the assets of the family or individual. Prescription drug coverage shall not be available for individuals who have qualified for Medicare Part A, with the exception of individuals who are eligible under the poverty-level, aged or disabled group (PLADs) provided in Section 43-13-115(11). The income eligibility for drug coverage shall be determined by the Social Security Administration and certified to the Division of Medicaid.
Further amend the title amendment by inserting the following after the semicolon on line 28.
