AN ACT TO ENACT A STATUTE OF LIMITATIONS ON CERTAIN TYPES OF CONSENT AGREEMENTS ENTERED INTO BY PUBLIC AND QUASI-PUBLIC ENTITIES; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The entry of a consent agreement regarding any allegation of civil or criminal wrongdoing in an enforcement action of any sort by any state authority or agency or other public or quasi-public entity, whether pending or having been concluded, shall be subject to expiration upon a fixed period of time, not to exceed seven (7) years, whether or not so expressed in the terms of the consent agreement, but only to the extent that the consent agreement obligates the subject of the enforcement action to either do or refrain from doing any action relative to the practice of a profession requiring a license issued under the authority of the State of Mississippi or running for public office. From and after July 1, 2005, every agreement subject to the provisions of this section shall be construed to comply with this section regardless of the actual date of the agreement.
SECTION 2. This act shall take effect and be in force from and after July 1, 2005.
