AN ACT TO CREATE SECTION 41-29-130, MISSISSIPPI CODE OF 1972, TO CREATE THE CRIME OF KNOWINGLY PROVIDING FALSE INFORMATION TO AN AGENT OF THE DEPARTMENT OF PUBLIC SAFETY DURING A CRIMINAL INVESTIGATION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The following shall be codified as Section 41-29-130, Mississippi Code of 1972:

     41-29-130.  (1)  A person who, in the course of any investigation conducted by an agent of the Department of Public Safety, in any statement made or writing or document submitted to the agent, knowingly and willfully falsifies, conceals, or covers up by any trick, scheme or device a material fact, or makes any materially false, fictitious or fraudulent statement or representation, or makes or uses any false writing or document, knowing the writing or document to contain any materially false, fictitious or fraudulent statement or entry, shall be fined not more than Ten Thousand Dollars ($10,000.00) or imprisoned not more than five (5) years, or both.

     (2)  This section does not apply to a party to a judicial proceeding, or that party's counsel, for statements, representations, writings or documents submitted by the party or counsel to a judge in that proceeding.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2005.
