AN ACT TO AMEND SECTION 63-1-15, MISSISSIPPI CODE OF 1972, TO  PROVIDE THAT IT SHALL BE UNLAWFUL FOR ANY DRIVER'S LICENSE EXAMINER TO ISSUE ANY DRIVER'S LICENSE OR DRIVING PERMIT TO A PERSON WITHOUT REQUIRING THE APPLICANT TO TAKE AND PASS THE APPLICABLE EXAMINATION; TO PRESCRIBE PENALTIES THAT MAY BE IMPOSED UPON CONVICTION OF SUCH OFFENSE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 63-1-15, Mississippi Code of 1972, is amended as follows:

     63-1-15.  (1)  The Commissioner of Public Safety shall be authorized to designate persons who may act as examiners for license or instruction permits.

     (2)  It shall be the duty of the license examiners to forward to the commissioner all applications rejected or approved in accordance with such rules and regulations as may be prescribed by the commissioner.

     (3)  It shall be unlawful for any license examiner to issue any license or permit to a person under this article without requiring the applicant to take and pass the applicable examination.  Any person who violates the provisions of this subsection shall be guilty of a misdemeanor and shall be punished, upon conviction, by a fine of not more than Five Thousand Dollars ($5,000.00), by imprisonment for not more than one (1) year, or by both such fine and imprisonment.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2005.
