AN ACT TO AMEND SECTION 63-3-519, MISSISSIPPI CODE OF 1972, TO AUTHORIZE ANY LAW ENFORCEMENT OFFICER OF THE STATE, ANY COUNTY, ANY MUNICIPALITY OR ANY POLITICAL SUBDIVISION OF THE STATE TO USE RADAR OR OTHER SPEED DETECTION DEVICES TO ENFORCE MOTOR VEHICLE SPEED LIMIT STATUTES OR ORDINANCES ON HIGHWAYS, ROADS OR STREETS WITHIN THEIR RESPECTIVE JURISDICTIONS; TO REPEAL SECTION 63-3-521, MISSISSIPPI CODE OF 1972, WHICH PRESCRIBES PENALTIES FOR PERSONS WHO VIOLATE THE PROVISIONS OF SECTION 63-3-519 RESTRICTING THE PERSONS WHO MAY USE RADAR SPEED DETECTION EQUIPMENT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 63-3-519, Mississippi Code of 1972, is amended as follows:

     63-3-519.  All duly sworn law enforcement officers of the state, any county, any municipality or any political subdivision of the state may use radar or other speed detection devices to enforce motor vehicle speed limit statutes or ordinances on highways, roads or streets within their respective jurisdictions.

     SECTION 2.  Section 63-3-521, Mississippi Code of 1972, which prescribes penalties for persons who violate the provisions of Section 63-3-519 restricting the persons who may use radar speed detection equipment, is repealed.

     SECTION 3.  This act shall take effect and be in force from and after July 1, 2005.
