AMENDMENT NO 1 PROPOSED TO

Senate Concurrent Resolution No.  540

     Amend by striking all after the resolving clause and inserting in lieu thereof the following:

 


That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:

     Section 210, Mississippi Constitution of 1890, is amended to read as follows:

     Section 210.  No public officer of this state, or any district, county, city or town thereof, nor any teacher or trustee of any public school, shall be interested in the sale, proceeds or profits of any * * * apparatus or furniture to be used in any public school in this state.  Penalties shall be provided by law for the violation of this section.

     BE IT FURTHER RESOLVED, That this amendment shall be submitted to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2004 as provided by Section 273 of the Constitution and by law.

     BE IT FURTHER RESOLVED, That the explanation of the amendment for the ballot shall read as follows:  "This proposed constitutional amendment removes the prohibition against teachers, school board members and other local officials from having an interest in profits from the sale of textbooks, to be used in any public school in this state."


     Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

 


     A CONCURRENT RESOLUTION PROPOSING TO AMEND SECTION 210, MISSISSIPPI CONSTITUTION OF 1890, TO REMOVE THE PROHIBITION THAT NO PUBLIC OFFICER OF THE STATE OR ANY DISTRICT, COUNTY, CITY OR TOWN THEREOF, NOR ANY TEACHER OR TRUSTEE OF ANY PUBLIC SCHOOL, SHALL BE INTERESTED IN THE SALE OR PROFIT OF ANY BOOKS, TO BE USED IN ANY PUBLIC SCHOOL.
