AMENDMENT NO 1 TO COMMITTEE AMENDMENT NO 1 PROPOSED TO

     AMEND on line 983 by changing the period to a comma and inserting the following language:

"except as follows:  The department shall issue a certificate of need to any for-profit corporation for which the majority of the shareholders are African-Americans and which employs fewer than one hundred (100) employees, to establish and operate a home health agency in such territory as may be authorized by the department in the certificate of need, provided that the home health agency established under the certificate of need serves Medicaid and Medicare recipients and provides at least a fifty percent (50%) discount on prescription drugs to Medicare recipients.  The provision of Section 41-7-193(1) regarding substantial compliance with the projection of need as reported in the current State Health Plan is waived for the purpose of the issuance of this certificate of need."

     AMEND FURTHER the title on line 6 by inserting the following language after the semicolon:  "TO AUTHORIZE THE STATE DEPARTMENT OF HEALTH TO ISSUE A CERTIFICATE OF NEED TO A CERTAIN FOR-PROFIT CORPORATION TO ESTABLISH AND OPERATE A HOME HEALTH AGENCY;"
