A CONCURRENT RESOLUTION PROPOSING TO REPEAL SECTION 210, MISSISSIPPI CONSTITUTION OF 1890, WHICH PROVIDES THAT NO PUBLIC OFFICER OF THE STATE OR ANY DISTRICT, COUNTY, CITY OR TOWN THEREOF, NOR ANY TEACHER OR TRUSTEE OF ANY PUBLIC SCHOOL, SHALL BE INTERESTED IN THE SALE OR PROFIT OF ANY BOOKS, APPARATUS OR FURNITURE TO BE USED IN ANY PUBLIC SCHOOL.
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendment to the Mississippi Constitution of 1890 is proposed to the qualified electors of the state:
Repeal Section 210, Mississippi Constitution of 1890, which reads as follows:
Section 210. No public officer of this state, or any district, county, city or town thereof, nor any teacher or trustee of any public school, shall be interested in the sale, proceeds or profits of any books, apparatus or furniture to be used in any public school in this state. Penalties shall be provided by law for the violation of this section.
BE IT FURTHER RESOLVED, That this amendment shall be submitted to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2004 as provided by Section 273 of the Constitution and by law.
BE IT FURTHER RESOLVED, That the explanation of the amendment for the ballot shall read as follows: "This proposed constitutional amendment repeals the provision which prohibits teachers, school board members and other local officials from having an interest in profits from the sale of textbooks, apparatus or furniture to be used in any public school in this state."
