AMENDMENT No. 1 PROPOSED TO

Amend by striking all after the enacting clause and inserting in lieu thereof the following:
SECTION 1. Section 97-32-13, Mississippi Code of 1972, is amended as follows:
97-32-13. (1) Any person under the age of eighteen (18) years who falsely states he is eighteen (18) years of age or older, or presents any document that indicates he is eighteen (18) years of age or older, for the purpose of purchasing or possessing any tobacco or tobacco product, may be subject to the following penalties, in addition to any other punishment authorized by law:
(a) For the first offense, the person may be required to perform forty (40) hours of community service;
(b) For the second offense, the person may have his driver's license or permit suspended for a period of thirty (30) days; or
(c) For the third or subsequent offense, the person may have his driver's license or permit suspended for a period of thirty (30) days and be fined not less than Twenty-five Dollars ($25.00) nor more than Two Hundred Dollars ($200.00).
(2) Upon adjudication of any person under the age of eighteen (18) years for a violation of this section, where the person is penalized under subsection (1)(b) or (c) of this section, the judge shall notify the Commissioner of Public Safety of the adjudication on a form to be devised by the commissioner and the commissioner or his authorized agent shall suspend the person's driver's license or permit to drive.
SECTION 2. This act shall take effect and be in force from and after July 1, 2003.
Further, amend by striking the title in its entirety and inserting in lieu thereof the following:
AN ACT TO AMEND SECTION 97-32-13, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR CERTAIN PENALTIES FOR YOUTHFUL OFFENDERS WHO VIOLATE THE UNLAWFUL PURCHASE PROVISIONS OF THE YOUTH ACCESS TO TOBACCO; AND FOR RELATED PURPOSES.
