REPORT OF CONFERENCE COMMITTEE
MR. SPEAKER AND MADAM PRESIDENT:
We, the undersigned conferees, have had under consideration the amendments to the following entitled BILL:
H. B. No. 854: Public property; clarify certain property to be transferred by MDOT to University of Mississippi.
We, therefore, respectfully submit the following report and recommendation:
1. That the Senate recede from its Amendment No. 1.
2. That the House and Senate adopt the following amendment:
Amend by striking all after the enacting clause and inserting in lieu thereof the following:
SECTION 1. Section 1, Chapter 354, Laws of 2000, is amended as follows:
Section 1. (1) In consideration for the conveyance of property authorized in Section 2 of this act, the Mississippi Department of Transportation shall transfer and convey to the University of Mississippi, acting through the Board of Trustees of State Institutions of Higher Learning, all of the right, title and interest in certain real property located within the County of Lafayette, described more specifically as follows:
From the Southeast Corner of the Northeast 1/4 of Section 29, Township 8 South, Range 3 West, of Lafayette County, Mississippi, run thence West 1644.0 feet to the point of beginning; thence South 17 degrees 16 minutes West, a distance of 328.7 feet; thence South 89 degrees 20 minutes West, a distance of 967.7 feet; thence Westerly along a line that is 150 feet Northerly of and parallel to the centerline of Federal Aid Project #F-020-1(4), a distance of 810.1 feet to a point that is 150 feet Northerly from and perpendicular to Station 217 + 00 on the centerline of said project; thence North 48 degrees 50 minutes West, a distance of 118.7 feet to point on the Easterly right-of-way line of the old Illinois Central Railroad; thence North 49 degrees 49 minutes East, a distance of 75.6 feet along the old railroad right-of-way line; thence East a distance of 1882.2 feet to the point of beginning, containing 11.65 acres, more or less, situated in the NE 1/4 of the SW 1/4 and the NW 1/4 of the SE 1/4 of Section 29, T-8-S, R-3-W, Lafayette County, Mississippi.
(2) The conveyance authorized in this section may be subject to additional terms and conditions accepted and agreed upon by the Mississippi Department of Transportation and the University of Mississippi.
SECTION 2. (1) In consideration for the improvements listed in subsection (2), the Mississippi Department of Transportation may transfer and convey to the City of Southaven, Mississippi, all of the right, title and interest owned in certain real property located within the County of DeSoto, described more specifically as follows:
Begin at the Northeast corner of Lot 12-D of 302
Industrial Park (Second Revision) Subdivision;
from said point of beginning run thence South
00° 37' West along the East line of said Lot 12-D,
a distance of 101 feet more or less, to the
Northerly right-of-way line of the relocation of
Mississippi Highway No. 302 as shown on the plans
for Federal Aid Project No. 54-0055-04-053-10;
thence run South 07° 29' West along said Northerly
right-of-way line, a distance of 243.0 feet to the
West line of Lot 12-A, a distance of 112.4 feet to
the Northwest corner of said Lot 12-A; thence run
North 89° 59' 53" East along the North line of Lots
12-A, 12-B, 12-C and 12-D of 302 Industrial Park
(Second Revision) Subdivision, a distance of 242.6
feet to the point of beginning, containing 0.60
acres, more or less, and being situated in Lots 12-A,
12-B, 12-C, & 12-D of 302 Industrial Park (Second
Revision) Subdivision in the Southeast 1/4 of the
Southeast 1/4 of Section 25, Township 1 South,
range 8 West, City of Southaven, Desoto County,
Mississippi.
(2) In consideration for the conveyance of property authorized in subsection (1), the governing authorities of the City of Southaven, Mississippi, may make improvements to the intersection of Southcrest and Goodman Streets, including the construction of a turning lane.
(3) The conveyance authorized in this section may be subject to additional terms and conditions agreed upon by the Mississippi Department of Transportation and the City of Southaven, Mississippi.
SECTION 3. (1) In consideration for the improvements described in subsection (2), the Mississippi Department of Transportation may transfer and convey to the City of Southaven, Mississippi, all of the right, title and interest owned in certain real property located within the County of DeSoto, described more specifically as follows:
Begin at a point that is 120 feet Northwesterly
of measured radially to the centerline of survey
of the relocated Mississippi Highway No. 302 at
Station 454+75 as shown on the plans for Federal
Aid Project No. 54-0055-04-053-10 at Highway Survey
Station 1616+34, said point of beginning is 49.4
feet North of and 1949.2 feet West of the Southeast
corner of Section 25, Township 1 South, Range 8 West;
from said point of beginning run thence North 01°50'
East, a distance of 68.7 feet to a line that is
parallel with and 140 feet Northwesterly of the
centerline of the left lane of said relocation;
thence run Northeasterly along the last mentioned
parallel line and along the circumference of a circle
to the left having a radius of 11,319.16 feet, a
distance of 53.9 feet; thence run North 88°29' East,
a distance of 450.4 feet; thence run North 87°27' East,
a distance of 124.5 feet; thence run North 87°29' East,
a distance of 243.0 feet to the West line of Industrial Drive; thence run South 00°37' West along said West line
of Industrial Drive, a distance of 79.7 feet; thence run South 86°57' West, a distance of 219.2 feet to a point
that is 100 feet Northwesterly of and perpendicular to
the centerline of survey of the said relocated Mississippi Highway No. 302 at Station 461+35; thence run South 03°36' East, a distance of 22.1 feet; thence run South 89°46' West, a distance of 159.3 feet; thence run North 04°45' West, a distance of 13.5 feet to a point that is 100
feet Northerly of and perpendicular to the centerline
of said relocated Mississippi Highway No. 302 at Station 459+75; thence run North 89°52' West, a distance of
197.3 feet; thence run North 89°35' West, a distance of 297.6 feet to the point of beginning and being situated
in the Southeast 1/4 of Section 25, Township 1 South,
Range 8 West of DeSoto County, Mississippi.
(2) In consideration for the conveyance of property authorized in subsection (1), the governing authorities of the City of Southaven, Mississippi, may make improvements to and maintain such property.
(3) The conveyance authorized in this section may be subject to additional terms and conditions agreed upon by the Mississippi Department of Transportation and the City of Southaven, Mississippi.
SECTION 4. (1) The Mississippi Development Authority, acting jointly with the Yellow Creek State Inland Port Authority, is authorized to transfer and convey to Poplar Springs Free Will Baptist Church all of the right, title and interest in and to certain real property and any improvements thereon located in Tishomingo County, Mississippi, described more particularly as follows:
Part of the North 1/4 of Section 33, Township 1 South, Range 10 East and also referred to as the L.E. HARPER tract YECR-107 on the YECR MAP, more particularly described as follows:
Commencing at the N.W. corner of said Section 33; thence with the section line, East 2350 feet; thence S. 89° - 33' E. 41.0 feet to the S.W. corner of Poplar Springs Church property and the Easterly R/W of the railroad at corner 6-63 and the point of beginning hereof; thence continue with the section line, S. 89° - 33' E. 259 feet to cor. 6.62; thence S. 89° - 33' E. 210 feet to cor. 6-49B; thence S. 89° - 33' E. 308 feet to cor. 6-49A on the Westerly right of way of MS State H'way #25, 60 feet from centerline; thence with said right-of-way S. 9° - 12' W. 197 feet; thence S. 80° - 48' E. 10 feet; thence S. 9° -12' W. 56.26 feet; thence departing said right of way, run with the open line, N. 89° - 33' W. 870 feet, more or less to the Easterly right-of-way of the railroad; thence with said right-of-way, N. 19° - 27 E., more or less, 265 feet to the point of beginning. Containing 4.73 acres, more or less.
(2) The conveyance authorized in this section may be made subject to such terms and conditions agreed upon by the Mississippi Development Authority, the Yellow Creek State Inland Port Authority and Poplar Springs Free Will Baptist Church.
(3) Any transfer and conveyance of the real property described in subsection (1) of this section made to Poplar Springs Free Will Baptist Church before the effective date of this act, regardless of whether transferred and conveyed as specifically authorized by law, is ratified, approved and confirmed. SECTION 5. This act shall take effect and be in force from and after its passage.
Further, amend by striking the title in its entirety and inserting in lieu thereof the following:
AN ACT TO AMEND SECTION 1, CHAPTER 354, LAWS OF 2000, WHICH AUTHORIZES THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION TO TRANSFER CERTAIN REAL PROPERTY LOCATED IN LAFAYETTE COUNTY, MISSISSIPPI, TO THE UNIVERSITY OF MISSISSIPPI, ACTING THROUGH THE BOARD FOR TRUSTEES OF STATE INSTITUTIONS OF HIGHER LEARNING, TO CLARIFY THE PROPERTY TO BE TRANSFERRED BY THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION; TO AUTHORIZE THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION TO CONVEY TO THE CITY OF SOUTHAVEN CERTAIN PROPERTY LOCATED WITHIN DESOTO COUNTY; TO AUTHORIZE MISSISSIPPI DEVELOPMENT AUTHORITY TO CONVEY TO POPLAR SPRINGS FREE WILL BAPTIST CHURCH CERTAIN REAL PROPERTY LOCATED IN TISHOMINGO COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.
