AN ACT TO REQUIRE MARINE VIOLATION TICKETS TO CONTAIN CERTAIN INFORMATION; TO AUTHORIZE THE COMMISSION ON MARINE RESOURCES TO PRESCRIBE FORM AND OTHER NECESSARY INFORMATION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  All marine violation tickets shall be in the form prescribed by the Commission on Marine Resources.  All tickets shall be printed in the original and at least one (1) copy and such additional copies as may be prescribed by the commission.

     (2)  Each ticket shall show, among any other information as may be required by the commission, the name of the issuing officer, the court in which the cause is to be heard, and the date and time the person charged is to appear and answer the charge.

     (3)  The ticket shall include information which will constitute the complaint charging the violation for which the ticket was issued.  If the violation is dependent upon the location of the vessel of the person charged, the officer shall include the global positioning system (GPS) location on the ticket.  If the person disagrees with the GPS location, the ticket shall contain a plan for the person to state the GPS location reading from his vessel.  The officer issuing the ticket shall give the accused a copy of the ticket.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2003.
