     AMEND by striking lines 109-112 and lines 241-244 and insert the following:

If a consumer recovers any penalty provided for under subsection (*) of this section, the consumer shall recover all pecuniary damages not to include any noneconomic damages as defined by statute.  To the extent proven by competent evidence, the consumer may also recover other damages subject to the following limitations:
