     AMEND by deleting lines 75 through 80 in their entirety and inserting the following in lieu thereof:

     (3)  In all civil actions where an entitlement to punitive damages shall have been established under applicable laws, no award of punitive damages shall exceed the greater of two percent (2%) of the defendant's net worth or One Million Dollars ($1,000,000.00); however, in no event shall an award of punitive damages exceed Ten Million Dollars ($10,000,000.00).  The restriction on punitive damages under this subsection shall not be applicable if

     AMEND FURTHER, the title, line 2, by deleting the words "AGAINST A SMALL BUSINESS" and inserting in lieu thereof the words "IN CIVIL ACTIONS"
