AMENDMENT No. 2 PROPOSED TO

                             Senate Bill NO. 2403

                             By Representative(s) Holland

     AMEND by inserting the following new subsection after line 55:

          "(7)  In addition to any other fees required to be paid by persons or businesses for erecting and maintaining outdoor advertising signs designated under Section 49-23-5(d) and (e), an annual fee in the amount of Twelve Dollars ($12.00) shall be paid to the Mississippi Department of Transportation by such persons or businesses for each sign for which a permit is required under Section 49-23-11.  The fee shall be paid at the same time and in the same manner as permit fees are required to be paid under Section 49-23-11.  The proceeds from the fees paid under this subsection shall be deposited into a special account that is created in the State Treasury to the credit of the Mississippi Department of Transportation.  Monies in the account may be expended, upon Legislative appropriation, for the same purposes for which the department is authorized to expend funds pursuant to contract with Keep Mississippi Beautiful, Incorporated, under Section 65-1-165."

     AMEND FURTHER, the title, by inserting the following after the semicolon on line 2:  "TO PROVIDE FOR THE PAYMENT OF AN ADDITIONAL ANNUAL FEE BY PERSONS OR BUSINESSES ERECTING AND MAINTAINING CERTAIN OUTDOOR ADVERTISING SIGNS; TO PROVIDE THAT THE PROCEEDS FROM THE ADDITIONAL FEE MAY BE EXPENDED BY THE MISSISSIPPI DEPARTMENT OF TRANSPORTATION PURSUANT TO CONTRACT WITH KEEP MISSISSIPPI BEAUTIFUL, INCORPORATED;"
