AMEND by inserting the following new section after line 1760 and renumbering the succeeding section:

"SECTION 13. (1) Federal aid highway funds allocated to the Mississippi Department of Transportation, under the Surface Transportation Program authorization of Public Law 105-178 (the Transportation Equity Act for the Twenty-first Century), shall be distributed by the Mississippi Transportation Commission as follows:

(a) Not less than thirty percent (30%) of the bridge replacement funds shall be allocated to the eighty-two (82) counties of the state to replace deficient bridges in accordance with all rules and regulations of the Federal Highway Administration and administered by the Office of State Aid Road Construction;

(b) Not less than fifty percent (50%) of the funds appropriated to Mississippi and allocated to areas with a population of less than five thousand (5,000), shall be allocated to the eighty-two (82) counties of the state and administered by the Office of State Aid Road Construction; and

(c) Of the funds appropriated to Mississippi and allocated for sub-state distribution in any area of the state, the following amounts shall be allocated to the eighty-two (82) counties of the state and administered by the Office of State Aid Road Construction:

(i) For fiscal year 2003, not less than thirty percent (30%) shall be allocated;

(ii) For fiscal year 2004, not less than thirty percent (30%) shall be allocated;

(iii) For fiscal year 2005, not less than thirty-five percent (35%) shall be allocated;

(iv) For fiscal year 2006, not less than forty percent (40%) shall be allocated; and

(v) For fiscal year 2007, and each fiscal year thereafter not less than forty-five percent (45%) shall be allocated.

(2) This section shall stand repealed from and after July 1, 2010."

AMEND FURTHER the title to conform.
