House Concurrent Resolution 130

A CONCURRENT RESOLUTION AMENDING HOUSE CONCURRENT RESOLUTION NO. 127, 2002 REGULAR SESSION, TO PROVIDE FOR THE MATTERS WHICH THE LEGISLATURE MAY CONSIDER UPON RECONVENING ON FRIDAY, APRIL 12, 2002.

     House Concurrent Resolution No. 127, 2002 Regular Session, is amended as follows:

     WHEREAS, Section 36, Mississippi Constitution of 1890, provides that the House of Representatives, by resolution with the Senate concurring therein, and by a two-thirds (2/3) vote of those present and voting in each house, may extend a regular session of the Legislature for a period of thirty (30) days; and

     WHEREAS, the Legislature has determined that it wishes to have the opportunity to consider, during the 2002 Regular Session, certain bills passed by the Legislature at the 2002 Regular Session that the Governor may veto, without having to remain continuously in session while the Governor has those bills under consideration; and

     WHEREAS, Section 57 of the Mississippi Constitution of 1890 prohibits the adjourning of either house for more than three (3) days without the consent of the other house, and the Legislature has determined that a period of adjournment of more than three (3) days may be necessary:

     NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF MISSISSIPPI, THE SENATE CONCURRING THEREIN, That the 2002 Regular Session of the Legislature is extended for a period of thirty (30) days from the final day of the ninety (90) calendar days of the 2002 Regular Session of the Legislature, under the provisions of Section 36, Mississippi Constitution of 1890.

     BE IT FURTHER RESOLVED, That the House of Representatives and the Senate each may stand adjourned for a period of more than three (3) days from such date and time as determined by each respective house and, if before Friday, April 12, 2002, either the House or the Senate has received any message from the Governor vetoing any appropriation bill, or any revenue bill for deadline purposes under Joint Rule 40, or House Bill No. 589, 1317 or 1379, or Senate Bill No. 2189, 2858 or 2969, passed by the Legislature at the 2002 Regular Session of the Legislature, then the House and Senate shall reconvene at 10:00 a.m. on Friday, April 12, 2002; * * * otherwise, the House and Senate shall not reconvene.  Should the House and Senate reconvene on that day, the matters that may be considered are veto messages on any appropriation bill or on House Bill No. 589, 1317 or 1379 or Senate Bill No. 2189, 2858 or 2969, and bills suspended from the deadlines by House Concurrent Resolution Nos. 128 and 129, 2002 Regular Session.

     BE IT FURTHER RESOLVED, That the 2002 Regular Session of the Legislature will stand adjourned sine die at 5:00 p.m., Friday, April 12, 2002.
