AN ACT TO AMEND SECTION 43-13-118, MISSISSIPPI CODE OF 1972, TO REQUIRE MEDICAID PROVIDERS TO GIVE EACH MEDICAID RECIPIENT TO WHOM THE PROVIDER HAS RENDERED SERVICES A COPY OF THE BILL, DOCUMENT OR RECORD THAT THE PROVIDER SUBMITTED TO THE DIVISION OF MEDICAID TO RECEIVE MEDICAID REIMBURSEMENT FOR THE SERVICES RENDERED TO THAT RECIPIENT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 43-13-118, Mississippi Code of 1972, is amended as follows:
43-13-118. (1) It is the duty of each provider participating in the Medicaid program to keep and maintain books, documents, and other records as prescribed by the Division of Medicaid in substantiation of its claim for services rendered Medicaid recipients, and those books, documents, and other records shall be kept and maintained for a period of five (5) years or for whatever longer period as may be required or prescribed under federal or state statutes and shall be subject to audit by the division. The division shall be entitled to full recoupment of the amount it has paid any provider of medical service who has failed to keep or maintain records as required in this section.
(2) Each provider participating in the Medicaid program shall give each Medicaid recipient to whom the provider has rendered any services a copy of the bill, invoice or other document or record that the provider submitted to the Division of Medicaid or the division's fiscal agent to receive Medicaid reimbursement for the services rendered to that recipient.
SECTION 2. This act shall take effect and be in force from and after July 1, 2002.
