AMENDMENT No. 1 PROPOSED TO

Senate Bill NO. 3083

Amend by striking all after the enacting clause and inserting in lieu thereof the following:

SECTION 1. The following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the State Public School Building Fund, for the support and maintenance of the Minimum Education Program, for the fiscal year ending June 30, 2001 $ 23,000,000.00.

SECTION 2. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of any money in the State Treasury to the credit of the School Ad Valorem Tax Reduction Fund for the support and maintenance of the Minimum Education Program, for the fiscal year ending June 30, 2001 $ 5,263,245.00.

SECTION 3. In addition to all other sums heretofore appropriated, the following sum, or so much thereof as may be necessary, is hereby appropriated out of the Education Enhancement Fund as authorized by House Bill No. 776, 2001 Regular Session, to the State Department of Education for the support and maintenance of the Minimum Education Program, for the fiscal year ending June 30, 2001 $ 6,736,755.00.

SECTION 4. The purpose of the funds appropriated herein is to fully fund the Minimum Program for Fiscal Year 2001. The need for additional funding is to restore the Governor's Minimum Program budget reductions. In the event that the Governor restores or fails to implement any or all of the three percent (3%) budget reservation to the State Department of Education for the support and maintenance of the Minimum Program identified in the February 1, 2001, letter to General and Special Fund agencies, then this appropriation shall be reduced by the same amount that the Governor restores or fails to implement the budget reductions to the State Department of Education.

SECTION 5. This act shall take effect and be in force from and after its passage.

Further, amend by striking the title in its entirety and inserting in lieu thereof the following:

AN ACT MAKING AN APPROPRIATION FROM THE APPROPRIATE SPECIAL FUNDS TO THE STATE DEPARTMENT OF EDUCATION FOR THE PURPOSE OF PROVIDING FUNDS NECESSARY TO FULLY FUND THE MINIMUM PROGRAM FOR FISCAL YEAR 2001.
