AN ACT TO CREATE THE STATE PUBLIC PROPERTY COMMISSION WHICH SHALL HAVE FULL AND COMPLETE AUTHORITY OVER THE CONSTRUCTION, RENOVATION AND LEASING OF ANY STATE-OWNED BUILDINGS AND REAL PROPERTY; TO PROVIDE FOR THE MEMBERSHIP OF THE BOARD; TO PROVIDE THAT THE DEPARTMENT OF FINANCE AND ADMINISTRATION SHALL PLACE A MORATORIUM ON THE CONSTRUCTION AND RENOVATION OF ANY STATE BUILDINGS UNDER ITS JURISDICTION FOR WHICH CONTRACTS HAVE NOT BEEN LET; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Notwithstanding any laws of the State of Mississippi to the contrary, there is hereby created the State Public Property Commission, hereinafter referred to as the "commission," which shall have full and complete authority over the construction, renovation and leasing of any state-owned buildings and real property.
(2) The commission shall be composed of five (5) members to be appointed from the state at-large by the Governor.
(3) The commission shall elect a chairman and vice-chairman. A quorum shall consist of a majority of the authorized voting membership of the commission. The commission shall maintain minutes of all meetings. All members shall be notified in writing of all meetings. Such notices shall be mailed at least five (5) days prior to the date on which a meeting is to be held.
(4) Members of the commission shall receive per diem as provided in Section 25-3-69 and travel expense reimbursement as provided in Section 25-3-41.
SECTION 2. Notwithstanding any laws of the State of Mississippi to the contrary, the Department of Finance and Administration, including the Public Procurement Review Board, shall place a moratorium on the construction and renovation of any state buildings under its jurisdiction for which contracts have not been let.
SECTION 3. This act shall take effect and be in force from and after its passage.
