AN ACT TO AUTHORIZE THE DEPARTMENT OF WILDLIFE, FISHERIES AND PARKS, ACTING THROUGH THE DEPARTMENT OF FINANCE AND ADMINISTRATION, TO SELL AND CONVEY TO THE VETERANS OF FOREIGN WARS, POST 9122, CERTAIN STATE-OWNED LAND LOCATED IN SIMPSON COUNTY, MISSISSIPPI; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Department of Wildlife, Fisheries and Parks, acting through the Department of Finance and Administration, upon meeting the requirements of Section 29-1-1, may sell and convey to the Veterans of Foreign Wars, Post 9122, a parcel of state-owned property situated in Simpson County, Mississippi, and being more particularly described as follows:
Commence at the NE Corner of the SW/4 of the NE/4 Section 21, Township 1 North, Range 5 East, Simpson County, Mississippi, for the Point of Beginning; Thence run South 89° 00' W, 452 ft., Thence run South 35° 00' W, 267 ft.; Thence run South 28° 30' W, 291 ft.; Thence run South 88° 00' W, 117 ft. to the center of a Underground Telephone Cable line; Thence run in a south Southwesterly direction, 300 ft., more or less, to the Northernmost Corner of the property owned by the V.F.W. Post No. 9122 in May of 2000; Thence run South 41° 30' W, 290.4 ft. to a concrete marker on the R.O.W. of the Northbound Lane of U.S. Highway 49; Thence run South Westerly and along said North R.O.W. line to a point which is the Southernmost Corner of the property owned by the V.F.W. Post No. 9122 in May of 2000; Thence run South 89° 02' E, 751.27 ft. to the SE Corner of the SW/4 of the NE/4 of Section 21, Township 1 North, Range 5 East, Simpson County, Mississippi; Thence run North along and with the Quarter Section line to the Point of Beginning.
(2) The real property described in subsection (1) of this act shall be sold for not less than the current fair market value as determined by the averaging of at least two (2) appraisals by qualified appraisers who shall be selected by the Department of Finance and Administration and shall be certified and licensed by the Mississippi Real Estate Appraiser Licensing and Certification Board.
(3) The proceeds from the sale and conveyance of the real property described in subsection (1) shall be deposited into the State General Fund.
(4) The State of Mississippi shall retain all mineral rights to the real property sold pursuant to this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
