AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF TALLAHATCHIE COUNTY, MISSISSIPPI, TO PROVIDE WATER AND SEWER SERVICE TO THE TALLAHATCHIE COUNTY INDUSTRIAL PARK AND WITHIN A CERTAIN AREA OUTSIDE THE INDUSTRIAL PARK; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Board of Supervisors of Tallahatchie County, Mississippi, in its discretion, may provide or authorize its designee to provide water and sewer service to the Tallahatchie County Industrial Park located in the First Judicial District of Tallahatchie County, Mississippi, and within an area not exceeding three (3) miles from the boundaries of such park. However, no area certificated for water service to Charleston Utilities, Inc., may be included in the area for which water and sewer service is authorized to be provided by Tallahatchie County under this act.
(2) The authority conferred by this act may not be construed as an exemption from the provisions of Chapter 3, Title 77, Mississippi Code of 1972, as to the requirements of obtaining a certificate of public convenience and necessity, the jurisdiction of the Public Service Commission to regulate rates or any other provision of that law.
SECTION 2. This act shall take effect and be in force from and after its passage.
