AN ACT TO PROHIBIT THE CREATION OF NEW PROGRAMS THAT REQUIRE FUNDING THROUGH THE STATE DEPARTMENT OR STATE BOARD OF EDUCATION UNTIL AN ADDITIONAL APPROPRIATION IS MADE BY THE LEGISLATURE TO FULLY FUND ANY PROGRAMS UNDER THE DEPARTMENT OR BOARD IN WHICH A DEFICIT EXISTS; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. Whenever a deficit exists for the then current fiscal year in any appropriation made by the Legislature during the preceding fiscal year to the State Department of Education or State Board of Education, a new program that requires funding through the State Department of Education or State Board of Education may not be created until an additional appropriation is made to fully fund, during the then current fiscal year, those programs under the State Department of Education or State Board of Education, or both, in which a deficit exists. For purposes of this section, the term "new program" does not include a program that has been created before the then current fiscal year but requires new or additional funding in succeeding fiscal years.

This section shall be repealed on July 1, 2005.

SECTION 2. This act shall take effect and be in force from and after its passage.
