(4) From and after May 1, 2000, any "minority business" applicant shall be required to pay only ten percent (10%) of the initial filing fee for a health care certificate of need at the time of application. The remainder of the filing fee shall be due only if the applicant is awarded the certificate of need. For purposes of this subsection, the term "minority business" shall mean a minority business as defined under Section 31-7-13(u), Mississippi Code of 1972, being the public purchasing law.
